LOL, this is kind of like a reverse scammer thread ...... someone GAVE you (part owed) money and then didnt want to come claim the item - after 2 years:

I wouldve have stopped communicating after 4months.

Not the first time I have heard this, I know a fellow who was selling a custom Harley. Had a guy show up and gave him 500$ deposit for a week to hold. Never returned.

All I learnt from this thread is that Spikers side job is a lawyer apparently. He knows the laws crazy good.

I felt bad taking his hard earned money (Just didn't feel right) I'm at a point that i stopped giving 2 fucks about it. I didn't steal his money, he gave it to me and it's not my problem that he hasn't come and picked up his car in 27 months. Sorry not 23 months as i wrote before. 27 long fucking months.
    This.

Print them out, put them in a file folder in case you ever need them. But otherwise, I would agree that there is little to no risk with you proceeding to sell the car to a new buyer...especially after holding on to it for 27 months. If ever required, you can present a very strong case to a judge that you went beyond any reasonable expectations to honour the deal you made.

Sell that car. Enjoy the cash!

Factoring in depreciation, mechanical issues, and storage fee's, I'd say you're pretty safe to sell it and keep his money.

Despite all of beyond's assurances, I'd still talk to a lawyer to make sure that you aren't setting yourself up for a headache. A few hundred bucks (of his money) should be all you need to give you peace of mind

So, did you write out a Bill of Sale indicating the down payment and balance due upon pick up?

I did not write the Bill of Sale. I just wrote that he's giving me a deposit of $5000 and the the "Bill of Sale" will be given when he pays the remaining $4000. He signed it, i signed it and 2 witnesses signed it.

The point of a deposit is to hold an item for a buyer while they make arrangements to return and pay the balance. It's a partial payment to prevent the item from being sold to someone else.

In addition to 'storing' the vehicle free of charge for over two years, you've also been deprived of the additional $4,000 that you would have received from the sale had he retrieved the vehicle as originally agreed. And, of course, the issue of depreciation.

I don't think you owe him anything at this point.

There's really no details...Some guy gave me a $5.000 deposit and never showed up tp pick up the car. I waited "27 long fucking months"

After that, i sold the car to some dude in Medicine Hat and he texted me just when he reached MH saying that the water pump is leaking. That guy who didn't pick up the car probably jinxed it. Asshole.
I've seen that car for sale few times on kijiji

Well imagine if instead of writing that letter to the editor, she just posts on a car forum for car enthusiasts. That's Kritafo.
