Not sure how this is anything but homicide. The issue is that he was unarmed and shot in the back.

Nobody knows how the struggle in/near the cop car went, which is where he took the first shot, so that's open to speculation. But after he is trying to get away while wounded, whether he was actually fleeing or had his hands up, it doesn't make sense for the cop to continue shooting him until he is dead.

He's not innocent on the robbery issue, but we don't execute people for stealing cigars.

The complete ineptness of the department was also demonstrated in the days following, when they ordered news crews to stop filming, and when they arrested journalists in a McDonald's, using excessive force. In another incident, they tear gassed a camera crew, shot bean bags at them, and smashed their camera equipment.

Before you run with this, there actually isn't a report that states this. The coroner's report has not been released and the police have not reported how many tires the office fired/deceased was shot. Furthermore, there has not even been a determination of homicide in the case, that investigation is ongoing and independent of the Ferguson PD.

For a police shooting to be justified, the assailant doesn't always have to be armed for deadly force to be the appropriate response.

Other than extremely biased, self preservationists accounts, where's there an official report that describes the scenario like you did?

There's so much more to this that claiming there is no other option than homicide before all the intricate details of the altercation and the States specific laws are understood, is just stupid and reactionary.

It will be classified as a homicide because someone took someone else's life. It can be ruled as a justifiable homicide and the cop isn't charged, but it is a homicide.

Yes thank you for that, I'm aware of the definition of homicide. I guess we gave everyone too much credit to assume they knew he was talking unjustified while I was discussing the possibility it was justified.
