Is there some type of increased emission rate when it is cold from the EPA?

This lawsuit being in NA makes no sense. It's the C220 engine in question that has this functionality, which is allowable under EURO 6 guidelines, and it was (AFAIK) never sold in NA. The implicated models in the lawsuit is simply all diesel models in NA. Are they implying that because one engine acts differently in EU, their marketing is crap and they want money for it?

Which talks about the C220 CDI. Maybe these guys just want to be first in getting a lawsuit out in case it's across the board?
