Default Liability: Light Rail Transit Parking Lot Flooding

Liability: Light Rail Transit Parking Lot Flooding

    From Coworkers:

Insurance companies are telling their affected customs to go to "The City" for a claim, as they state this is parking lot is known for flooding

    The city sends them back.

    Who should pay?

If the insurance companies have to write off all those cars that got flooded at Southland LRT, the costs will eventually get passed on to all of us.

If the City has to pay, the costs will get passed on to us.

Shouldn't insurance be doing that for the customer ?

Pay the claims and re-coup from the city ?

I'd think insurance companies should be sorting that out for their customers.

Insurance should pay. That's why we pay for insurance.

The lawyers would argue that the City cannot reasonably prepare their parking lots for 100% of the eventualities of various acts of god.

Insurance claim needs to be escalated.

Wouldn't this fall under the 'No responsibility for damage, theft or vandalism' clause parking lots/companies have at their lots?

Don't you subsequently agree to this when using a parkade?

its nothing due with cheapening out , some people pay in the hundreds for best insurance and still get the run around in some cases.

Which junk insurance comapany is this? The reason why we buy insurance is so that these things get looked after. If the insurance thinks it's the city's responsibility, fine, but shouldnt they be the ones chasing after the city for liability instead of getting the client to do their job for them?

Another reason why I hate insurance companies and those damn bureaucrats that run them

I have never met people anywhere that hate their jobs as much as in the insurance industry.

Can confirm. The few friends I've had working in insurance despised it and are no longer there. They were also incentivised to deny claims in any way possible and there were regular internal discussions about just that.

Something really doesn't add up here, I've never seen anything like that. I suspect there's some miscommunication here. Do you know which company(ies) are involved?

Did claims adjusting for a few years at a few different shops.

None of them ever had a culture of denying claims or meetings around this. If the policy covered the loss it was covered per the terms of the contract.

Likely these people don't have comprehensive coverage and don't understand that's why they are being told to check with the city (excuse by the insurer to get them to go away - the claim isn't covered regardless.)

City says they are not liable and to check with their insurance company... back and forth it goes.

If you have comprehensive coverage and are being told to go elsewhere then call back to get a new claims person or escalate to a supervisor. You might just have a newbie that doesn't know what they are doing. If that gets nowhere then escalate to the insurance ombudsmen office.
