    Getting rid of the demerits wouldn't do anything for him if he has a relatively clean record, insurance only cares about the ticket written not demerits.

    Update!!

    Went and spoke to the crown in August and they offered a reduction in points and the fine both but I was kind of miffed as the chick was texting the entire time I was trying to talk to her and she didn't give two hoots about my story. I could have been speaking Klingon and I don't think she would have even noticed. In the end I told her I wanted it withdrawn completely and she said no and that I would need to plead not guilty and set a court date if I wanted to talk to stand in front of a judge so I did that.

    They wanted a court date in either October or November and I said that it would work for me because of the busy season and that it either has to be in September or January so they gave me Sept 13 so needless to say, today was my big day in court!

    I showed up at the specified time and registered and spoke a bit with the crown prosecutor and he said he would speak with the police officer who wrote the ticket and to sit and wait to be called for my trial. After about 45 minutes and watching a few of the trials before me they called my name and I stood in front of the judge. She confirmed who I was and then the prosecutor stood up and says "After speaking with the officer the crown has decided it is not prepared to pursue the charges" and the ticket was formally withdrawn and I was told I was free to go... That's it! Yay for me!!!

    I don't know if I did something right or if the officer had done something wrong as he was present for the trial, but I don't care and am super happy I took it all the way.

    Sometimes things do work out for the little guy!

    officer was just hoping that bob would pay it and go away?

    what's the % of ppl actually showing up to court?

    You did nothing wrong and safely passed in a quick manner. There SHOULD be some leeway within a reasonable time frame.

    A friend of mine was nailed in BC with this same scenario, went to pass a pickup with a trailer going under the limit and police nailed him for 41 over (90km/h zone). Car was impounded for a week, large fine, bus ticket home, etc... Cost him over $3k all said and done.
    They don't want you in BC ... so don't go there. I don't.

    Good to hear it got dropped Bob, always hate passing slow drivers that speed up during a pass.

    I hope it's changed since a few years back when charges got stayed when someone from Calgary tried to fight it. Sure he didn't have to pay the speeding ticket, but still lost the car for a week and had to pay all the impound fees.

    officers show up a lot less than people think. it's almost advantageous to go to court for every ticket. obviously lasered or ones in the mail won't work like this.

    I'm quite honestly surprised they withdrew it. You admitted guilt, and were going noticeably over. The rule, as I understand it (and as has been reiterated in this thread) is that when passing, you are not allowed to speed. Looks like an open/shut case in deciding your guilt.

    I believe they decided not to "pursue charges" because they realized WHY you did what you did, and actually decided to use some common sense rather than go strictly by the book.

    Good on you for following it through, and congrats on the win.
