So people are using my photos to market their products. Umm...

So, a watch company based in Denmark is using a photo I shared on Instagram to market their watches. It's not a huge deal in the scheme of things, but they aren't crediting me... and neither are the websites that are using my photo when talking about their watches.

The photo doesn't have my logo on it (taken as a wrist shot for insta).

TL;DR -

+ Took photo on WYCA instagram of wrist shot for watch
+ No logo in photo
+ Watch company starts using photo on their instagram and website. They are also sending the photo to other websites to use.
+ Nobody is crediting me at all.

They did not ask me to use it.

I want to be credited back. That's all. What's the best way to go about that?

Happens all the time sadly. Check the legal terms of Instagram and see what exactly you could do. Then ask the company to credit you, which some companies are willing to do. Others you'll just never hear from unless, from what I've read, you have a legal team.

A buddy of mine did a drone video in Banff NP and some Spanish tour company stole it and got like over a million some views on YouTube. Drones are now banned so it's worth even more now. He finally got credit for it but never saw any cash.

It's the risk people take, myself included. Social media and photos sharing sites like 500px and Flickr are great platforms for marketing but risk getting your material stolen and have someone else profit. It's horseshit but most don't have the money to pursue it beyond asking.

I guess the short answer is ask them to be credited because you have the original to prove it, and see where that takes you.

I guess this instance was simpler than I thought it was going to be.

Never hurts to ask for money or work something for future work? I can't say I'd be overly optimistic about it but might as well try! Or I guess that's what I'd do lol

Often times in this situation people will send a bill to them for usage-to-date, and request it either be taken down or quote a price to continue using it with credit to the owner. Sounds like it's not a big deal though and you got it sorted out.

Yay but hand models run 3-500u$d/hr - you're underselling yourself.

You should ask if they have the release from the model

I would ask them for some money or at least some credit on a new watch, or even ask them to send you one of their top watches otherwise remove the photo, which would be a hassle for em i bet

Not really looking for cash. The pic it just a wrist shot I took while wearing their watch for Instagram.

More than anything, I'd just like a link back to my site. They seem to be alright with that.

Yea, they said they'd add my logo to the photo before distributing it. We'll see if they actually do it.
