    Hey beyond, wondering who all is working Monday Jan 2, and also do you expect stores to be open that day? Holidays are strange this year with Christmas and New years falling on the weekend.

    For the poll, you can select multiple options, work/no work and expect stores to be open/don't expect them to be open

    My head office is closed but since I am under contract for the city we work as they are open.

    What's great about the states is that if a federal holiday is to fall on a weekend, the following Monday is deemed a federal holiday as well. Canada should really adopt the same policy

    Most companies follow this anyways, even though Canadian law stipulates it can be either Friday or Monday.

    Alberta and BC are different that way.

    In BC it's law that if the holiday falls on any day of the week, you are entitled to 8 hours of pay, or a day off with pay.

    In Alberta, if the holiday falls on a day you don't normally work. (ie Saturday or Sunday for most people) then you are not entitled to anything since you didn't work that day.

    Most reputable companies give a day off with pay regardless...but Employment Standards Alberta don't require it by law.

    I seem to definately recall working jobs in my youth where we all wanted to work the stat as we got 1.5X pay, but if we didn't work, we didn't get anything...I may just be remembering it wrong though.

    In my current role, my specific team in 24x7x365 that requires a minimum staffing level where if there are not enough people, you can be required to do mandatory OT. All stat for us is as you described it though, however, we do 12.5 hour shifts, and if we get a day off because of a stat, we only get 8 hours banked.

    No you're right. If you DO work on the stat, then law requires that you get paid OT rates (time and a half) but if you don't work that day, then you don't get anything extra.

    Alberta Employment Standards:


    Eligible employee not normally scheduled to work on the general holiday - Does not work
    If an employee who is not normally scheduled to work on the general holiday does not work, the
    employee is not entitled to receive pay for the holiday nor another day off with pay
    In BC, you get a day off with pay, or 8 hours of pay in lieu of the holiday. So in this case, if you didn't work Sat/Sun, but went into work on Monday, you would get an additional 8 hours of pay. And if you didn't work on the Monday, you would still get paid for it. And if you WORKED that stat, then you got time-and-a-half PLUS another day off with pay!!

    BC Employment Standards:

    Statutory holiday on a day off

    When an employee is given a day off on a statutory holiday, or it falls on a regular day off, an eligible employee is entitled to be paid an average day’s pay.

    I'm not working, but only because it happens to be my week off. Nothing to do with it being a holiday or not.

    Damn looks like I have been over paying my 1 employee. Looks like I gotta change it for 2017. Thanks Dave haha I always treated it like the BC example.

    Except Christmas and New Years fall on Monday next year...so if they normally work on Monday, then they'll need a day off with pay! You missed the boat, Max!! Hahaha

    I'm surprised there aren't more employers who aren't aware of this. I talk to so many people (both employers and employees) that think you get a day of pay for a stat, regardless of what day it falls on.

    My DIL works for TransCanada...she didn't work Christmas, nor Boxing day, and gets no money for those days!!

    Our Edmonton corporate office has Monday as a stat, us in our remote Calgary office have to work.....……

    I expect retail to always be open, any part time rotating schedule type jobs don't really have an excuse. Like spikers said, 1.5x is a great motivator for staff

    yes, I get 9 hours in lieu. But we work all holidays. I was working last Christmas weekend all weekend.
