    Default Neighbor downspout/retaining wall issues

    Wondering if there are any concrete experts that can chime in on what is happening with the shared retaining wall I have with my neighbor.

    To me, it looks like the downspout he has running from his roof, along the fence wall, and along the top of our retaining wall is leaking and water is damaging the wall. I can pick apart the concrete by hand and there is a pile of concrete debris forming on the base of the wall. He's saying there is no leak from his side.

    Am I missing something? Does concrete do this naturally? I'm trying not be an a** but this is going to cost both of us if it's not taken care of.

    What do you guys think?

    Where is his downspout pointing towards?

    My old house, my neighbor had his downspout pointing towards my house and there would be water by my front steps. I told him to point it towards his driveway. Never had any issues after that.

    Probably not the answer or advice you're looking for, but thought i would post it anyway.

    Very Common. It's called Spalling and just needs a new top coat to help seal out the moisture.

    This link is for a driveway but could be applied to your wall.

    Also, just so you know - it's not a shared retaining wall. It is the responsibility of the property owner that is on the higher side of the grade separation.

    Would you have a link stating this? I've looked on the city website and I wasn't able to find a definitive answer.

    Yeah, similar issue... all I'm asking him to do is extend his downspout so that it goes along the ground instead of along the retaining wall. I think its a pretty easy fix but he's denying the issue even exists.

    At one point, he had his downspout hanging over the fence and literally splashing onto my deck causing water issues in my laundry room.

    Thanks for the link! I didn't know what to call it but now I do!

    I'm willing to pay for and fix my side of the wall but that would only help for the time being... a more permanent solution would be to additionally move the water source.

    Will probably have to pull a real property report to find out your specific case...

    Retaining walls being owned by the higher side is just a general rule-of-thumb

    You are right, this is spalling. However, it may not be as simple as just applying a top coat if the rebar has been compromised or the structural integrity of the concrete itself has been weakened. In this case, its not really a structural concern so i wouldn't do any testing but..

    OP: Look for evidence of rust indicating that moisture may have made it to the rebar. If it has, then you will see more rapid deterioration over time and it will start breaking off in chunks. The cause of this is 100% moisture and is likely where you get ice build up from the eve directly above.

    Thanks for all the info and help guys!

    In the end, after reviewing my Real Property Report, the structure is actually on his land and he is also the guy at the higher elevation. The CoC Development Permits team, the CoC Drainage team, as well as the CoC Neighbour Mediation team all confirmed he is responsible for the retaining wall.

    I have informed him of the issue and done my part to save him headaches.
    It is up to him to deal with it.
