The FDA is looking at forcing cigarette companies to drastically drop the nicotine levels in their cigarettes.
I believe FDA rulings are pretty much ironclad, if they say a specific drug is illegal over a specified amount, its illegal. If the FDA rules against sliced bread, it is illegal. If the FDA says that every loaf of bread must be wrapped in a sanitary wax paper, then that is the only way it can be sold.
They pretty much have autonomy over what is OTC and what is not.
Whatever milligram amount it works out to be, they seem to be targeting the new cigarettes to be 1/20th the potency of the current tobacco cigarettes.

BTW: I totally missed the 19 different anti-bacterial chemicals that were banned from sale.
