    This story ended up being pretty crazy. As seen in the original article, the original investigation had no charges being laid. The parents were obviously upset and demanded charges.

    This was all over my facebook feed last year (I have lots of friends from Bowness growing up), calling out cops for not doing their jobs, and even saying they were racist (the dad is black). Under pressure, the cops filed charges against the driver. Careless driving, and operating without insurance.

    Fast forward to this week, it went to trial. Operating without insurance was dropped before trial start, she didn't have her papers but was in fact insured. Today, after witnesses testified to exactly what was said in the first investigation, in that she stopped and was waved through, prosecution dropped the careless driving charge.

    The family is still trying to sue the driver in civil court. I'm disappointed that the system totally fucked over the driver here over public pressure that really wasn't warranted or justified. Not only did she have to deal with the emotional impact of killing a 4 year old girl in an unfortunate accident, but she has to deal with the financial fallout of legal costs. I seriously hope this isn't the norm.

    The driver's insurance will most likely be denying liability and it'll eventually be litigated in civil courts unless the insurance company wants to make it go away and settle it for an amount without admitting liability on their clients' part. It'll be interesting to see I suppose.

    If its true they waived her through, as witnesses have stated, that could be a tough trial.

    Can someone link an article that says witnesses saw the driver was waved through? I can't seem to find any.

    Are you just reading headlines or something? The first 3 articles in my OP talked about waving the driver through, including reference to the police press release.

    Here's a couple articles with more details about the 3rd party witness who saw it unfold, and ran to help the girl.

    It was in an earlier article this week, the driver testified that the mother waved her through. Looks like they updated the articles with the charges dropped today and removed the driver's testimony altogether. Only have the 3rd party witness statements now since that's more relevant, and he only mentioned he saw brake lights. I hate when they do that.

    Yeah, just wondering if the witness's saw the wave-through, or maybe it was her yanking up her dogs leash trying to break up the fight (which would be difficult to tell, really).

    Regardless, pretty f'ing sad. I can't imagine being the parent, or the driver.

    Yea this is very sad for everyone involved, but I do feel like the parents want to accept 0 blame.

    Also, this is one reason why all my vehicles have dash cams (not that it would have caught someone perpendicular to the vehicle waving, though). The driver probably spent 10-20k defending her innocence when a 50$ dash cam could have potentially settled the case.

    This is how I felt from the start, and yea, I'm feeling less and less sorry for the parents. Earlier this week, the comments on the FB thread were brutal, bitching about the system how careless driving her fine is going to be max $2000 and no jail time, and she should be in jail for life.     A bit off topic but I love when pedestrians try to overrule the rules of the road and then cry victim when something happens.

    Case in point, this chick was at a crosswalk, visibly waiting to cross and a bunch of cars had stopped to let her cross. She waved us through and one car (lol) actually went.

    I was like nope, fuck that. And she finally relented and while she was crossing, I rolled down my window to tell her to stop fucking with road rules and just cross next time.

    yup. or you get hero drivers who stop at a green light and let some old person jaywalk across a red. that's how people get killed

    i never give the right of way if i have the right of way. it's just better that way cuz it can fk shit up.
