    Default Scammed by employer

    Just wondering if I have any options or if I'm out of luck

    Came across a night shift labour job in early Feb and figured it could help me out with school bills and all. A new company supposedly just started. Filled out payroll and tax paperwork and all, seemed legit. Boss (owner) has a LinkedIn page advertising the company services flyers and all, even took me to his house to drop off equipment a couple times

    Issue is that he won't pay me. Missed the direct deposit date and and says his house got broken into so he's going through some trouble and will get back to me later. Doesn't answer my calls. Meanwhile he's posting snowmobile pics on Facebook showing off his new toy.

    I don't have any contract of paperwork other than text messages. Can I do anything? There were other employees there too but I never got any of their contact info because I only worked a couple shifts. The amount owed is under $1000 so not worth the time or money to get a lawyer involved

    Saw that, one of their requirements is a "record of employment" which I don't have. I don't think I have any official proof of employment other than text messages. All the paperwork was signed and given back to him (I should've made copies, I know). Also doesn't seem like the complaint form does anything more than tossing dirt on the business name

    You may be at the point of threatening him if he won't pay. Threaten to ruin his business reputation on LinkedIn and Facebook, threaten him with employment standards complaints.

    If he's the kind of guy who cares about that stuff, maybe it helps?

    I'd file a complaint with the CRA. My guess is he's being shady in his "business" reportings, etc.
    You're unlikely to see that money. He never filed you as a worker.

    Text messages can be used as evidence and if they explicitly indicate he was working for you, it should be enough to sway a judge. You wouldn't need a lawyer in small claims - you just have to decide if it is worth your time and stress.

    I know in BC I dealt with what was called the "labour board" for an issue I experienced with an employer, which TOTALLY helped me out. We might have the same thing here.

    I would first outline to him what your plan is. "If I do not receive the outstanding balance by _____________ then _______ will happen". Make the first demand a short timeframe, and escalate in relatively short order from there.

    Thanks guys, I had a document printed out stating the hours I worked and the amount owed and told him I want it signed by tonight or I'm going to small claims. He tells me im now "fired" and therefore he has 10 days to pay me according to the labour guidelines. From what I've read, that doesn't excuse 2 months overdue paychecks and doesn't apply unless it was me who quit. I told him I can wait 10 days if I get that paper signed and have it in writing.
