My understanding of this is that it is usually either grey market (meaning they are sold by an authorized agent outside of the terms of their agreement, could be product destined for other countries sold at a discount internationally) or they are an imitation fragrance. Again not technically illegal (unless they are sold under the label name rather than "smells like XXXXX brand" as you cannot technically trademark a fragrance. In order to trademark a fragrance you would have to be able to visually represent the product's scent which is impossible.
