    Default Careless Driving Ticket

    So my Mother in Law was charged with careless driving last night and she sent us a copy of the ticket which just says "careless" driving and has a fine of $543

    Dont tickets have an explanation field somewhere that says what the reason was for it? She doesnt speak english and the cop didnt speak chinese but she thought he was charging her with drunk driving (did not test her and its not mentioned on her ticket) neither is the reason for the careless driving.

    I presume she will also get 6 demerits.

    That's a big one and probably worth fighting. What was she doing wrong? Or won't she admit anything?

    she told us she wasnt doing anything. And she doesnt know what the police was telling her because she doesnt understand english. Other than he told her she didnt pull over fast enough and that she must of been driving drunk.

    Cops don't pull over old Asian ladies for no reason... just go to court with her and find out.

    This would've been a good time to have had a dash cam. My wife got a ticket for a rolling stop, dash cam video proved without a doubt she did hahaha

    +1 for terrible driver.

    After having commuted down centre St into DT through the 16th Ave area all the way down through Chinatown for a couple years, I can honestly say i wish the police gave more tickets like this out. Not saying this is specifically ops mil, but there are way too many people behind the wheel that have no business being on the road.

    Definitely go to court and hear what the officer has to say, I'm interested haha.

    Edit: guarantee he didn't say she must have been driving drunk, then didn't even test her or ticket her for that.

    My wife seems to think we can just send one of those fight the ticket places and then she doesn’t need to go but I’m sure that is not the case. She also seems to think the policeman 9/10 doesn’t show up to court I think that is also not true. This happened in Edmonton so it would be a pain in the arse for us to actually go with her.

    We actually get people come in to retain us that are charged with these offences all the time because of the large amount of demerits they carry and potential suspension (depending on the record) and increase in insurance possibilities. If you retain a lawyer or a traffic agent, she would not need to go to the first court date. Eventually, depending on what is happening and if she's taking the matter to trial then she would need to go. However, if she is pleading guilty then that can be done by a lawyer and I am assuming an agent. The ticket itself generally doesn't contain an explanation and that comes with the disclosure which should be requested for sure if she seems to think that she didn't do anything wrong.     Helps to have context OP. Youve not told us anything about what really happened. If your mom cannot read English signs, she might have pulled some dumb stunt without even knowing.

    Does your mom have a history of driving citations?

    Can't you get the disclosure without even having to go to court, just so you know what the cop saw before he ticketed her?

    So we are getting some more info now. A chinese translator told her (unsure this happened at the time or called her today) that someone from the public reported her as driving drunk and not driving stablely, however we are unsure that the cop actually witnessed this or just wrote her up based on what the person that phoned in said. She was not drunk nor drinks alcohol at all or was tested at the scene. And drunk driving wasn't the charge either. I emailed fightthatticket.com and they want around $500 to see if they can get her off it.

    So most likely driving erratically which was spotted by the officer and probably did something very dangerous.

    I know it's your mom and benefit of the doubt is easiest but this sounds like she did something very wrong and should own up.

    On a side note: Why is it that Asians feel the need to drive 90% of the way through a left turning intersection to within inches of my kneecaps when crossing a street when there is absolutely no oncoming traffic at all?

    I’d say fight it for sure. However contrary to what some people believe cops don’t just randomly single people out for things like careless driving.

    I’m guessing you already know she’s a bad driver, if she did something that bystanders and/or police took notice of AND has such a lack of self awareness she doesn’t think she didn’t anything wrong then a COP slapping her with a ticket won’t teach her a single thing. She’ll probably think they’re out to get her. Having her son tell her honestly would probably have a much larger impact than any monetary/demerit punishment

    If the real story is she was driving bad enough to warrant a call that she's drunk, she's a hazard to herself and everyone on the road. Teach her how to Uber, and sell her car

    10/10 serious, btw.

    I don’t know what happened but other than this in the last ten years she’s had no issues and drives from home to work and back nearly every day. I don’t think that warrants her never needing to drive again because of one supposed issue where she may of swerved in or out of her lane.

    Would your opinion apply to your own parents if you were in our situation
