Always pull your drivers abstract after pleading guilty to a lesser offense.
I got a speeding ticket in March, my first speeding ticket in many years. 123 in an 80 - yah, I got sloppy and hauled ass. Robotic sheriff pulled me over. Ticket was $270 and 4 demerits.
Since I drive for UBER, 4 demerits will disqualify me from driving. So, I did a consult with a traffic lawyer in Red Deer who also has experience with this sheriff as well as the Crown and judges and what not. He said he could probably get the charge withdrawn as long as I agreed to a lesser offense. My only concern was with the demerits. First court date comes and it gets put over for another 2 weeks or something. Second date comes and the Crown offers two plea deals.
1: Speeding fine for 175 and 3 demerits.
2: Failure to obey a traffic control device fine for 270 and 2 demerits.
Third and final court date comes to enter a plea. I chose option number 2 because, as I said, my only concern was the demerit points. Plea is entered, speeding charge is withdrawn by the Crown and I'm now guilty of failure to obey a traffic control device. I'm given time to pay until July 31.
I pay the fine, all is well until I pull my drivers abstract yesterday and see a conviction of speeding carrying 4 demerits. My lawyer specifically told me to pull my abstract a couple weeks after all is said and done to ensure no mistakes are made. Well, pretty much everything I'm looking at is wrong. I guess that's government incompetence for you.
So I head to the court house with all my documentation from my lawyer and my abstract. Did all the explaining and she takes copies of everything and says she is going to fax everything to Driver Fitness and Monitoring (lol, who in the fuck uses a fax machine anymore!?!). She tells me to pull my abstract again in 2 weeks and it should be all cleared up.
Moral of the story: Don't trust the government to do its job correctly. If you're doing anything other than paying the original fine/ticket, be sure to pull your abstract after. You don't want extra demerits on your abstract going unnoticed.
