Keeping in mind this is Texas... who is at fault?
This should be a great debate, social media comments have been fantastic

That was pretty fucking dumb to threaten to kill two angry, armed men, regardless of how the fight started, or who was legally in the right.
Give both families free weapons and ammo. Problem will take care of itself.
Well, the guy who shot him provoked him by pointing the gun at him.
https://www.brodenmickelsen.com/blog...law-explained/
Pretty clear stand your ground doesn't count if you provoke people. The guy and his son brought guns to what? Keep the guy from putting the mattress in the bin?
The guy was also not on his own property, another big issue. I don't think the guy in the orange shirt was unreasonable if the guy was brandishing weapons at/around his kids and threatening to shoot him.
All speculation, there is such little detail, the video (as is often the case) doesn't show important parts leading up to the shooting.
I just can't see the shirtless wonders getting off scott free though.
At some point the victim grabbed a bat... he was uttering threats, and he was warned (when he had the bat) not to step within 3ft of the old man. He did, and got shot, you can see the bat flying after he got shot.
Having a gun on you in an open carry state seems like a pointless argument to make, the old man stayed calm and kept it pointed down when shrek was verbally assaulting the shit out of him. I think the old man has a strong self defence claim, and even if the “why did you have the gun” question is asked... well, this was an ongoing neighbour dispute. Being neighbours he probably was already aware of the victim’s violent nature. The shotgun wonder though... probably a conviction... depending if his shells even hit or not will dictate the nature of the conviction
While I agree with the uttering threats comment, the gentleman with the gun also threatened the guy. In addition, he brandished a weapon. I don't think in open carry states, you are allowed to point your gun at anybody anytime you want. This quote is hidden because you are ignoring this member. Show Quote
Also, everything else you said there is strictly conjecture. I saw no "bat" and I did not see the guy go towards the person with the gun. Maybe you saw a different video? There are different ones out there that have been edited apparently. Edit- also, the gentleman with the gun was clearly provoking the situation, which as stated, nullifies castle law/stand ground laws typically.
I do find it interesting that you take the side of the person who isn't upset. Can you imagine (if it is a true claim) somebody brandished a pistol/shotgun at you in front of your kids? Or at your kids/in the general area of them?
Clearly I am pro stand your ground and castle law. I don't think any of those count. I don't think you can go retreat, grab a gun, gp onto public property, and tell someone they can't go within X radius of them.
Maybe I'm wrong. I'm just saying, I don't think this is clear cut stand your ground. The only thing that may factor in is the orange shirt guy said "I'm going to kill you".
But the shirtless guys said they'd kill him to. unno:
This is why everyone is polite in Texas.
Hitemp... read the article, and perhaps rewatch the video, I told you exactly when the bat is visible
It’s quick, but clearly a flying bat...

On Friday, police said that when the first shots were fired, Howard had a bat in his hand but was about seven feet away from the Millers. After the first two shots, police said, Howard was unarmed, but the Millers fired again.

Both parties are beyond stupid. Play stupid games win....
Why the guy with the bats wife was cheering him on instead of deescalating is so stupid. Then she's surprised he was shot by two people saying they would shot. Always use emotional intelligence. Especially with stupid people that share dentures with one another.
By my estimation: Everyones a winner.
Cocoa $11,000 per tonne.
So the shooters dumped their mattress to neighbor's property, neighbor threw it out and that started this?Box and Howard had thrown the mattress in the dumpster a couple days earlier, she said. But on Sept. 1, they saw the mattress back on their property. So Howard moved it back to the dumpster. Box said Howard’s nieces, nephews and brothers were with them, too. She told the paper that she and her husband then watched the elder Miller, John, walk to the dumpster, pull the mattress out and toss it back on Howard’s property.
Victim dumped a mattress into a dumpster that was in the alley (probably belonging to neither house), then the shooter threw it back on the victims property (several times). This quote is hidden because you are ignoring this member. Show Quote
