of course they are! I have no idea why people are so honest. Or maybe they (possibly religious) think its unholy to not tell the truth.

My company has no formal policy but after an informal poll of the staff it seems like nobody is going to be changing thier usage patterns anyway. Management will monitor the situation.
Update? It's been a few weeks. Any employees showing up not fit to work?

Well, possibly it's because getting turned away at the border is not illegal, while lying to a federal officer is?

It's interesting the contrast of Canada moving forward and the US moving backward with respect to social policy.

The Devil's Lettuce, Gun Ownership and Non-Whites are clearly still top issues for the US, circa. 1906

I mean how do they know if you are lying or not, were they there at the time. And they arent getting turned away they are getting a lifetime ban from the US.

My thoughts exactly! They've been well fore warned that usage could lead to a ban way before legalization even took effect. Even if you thought they were just BS'ing us all, why take the risk? Just say no and move along.

I find it interesting that people seem so consumed about employers needing to change policies. Legally the employer has all the right to ban you from their site for testing positive. "Oh but they have to prove impairment!!" Really? When's the last time someone tested positive for alcohol and was then taken for a sobriety test? Never! Same goes for Cocaine, you do a rail Friday night, you'll still test positive Monday morning and be fired. Albeit Coke is illegal so it could be a tad different. But to put in legal perspective again, you test positive for prescribed Oxy, and didn't tell your employer, they can fire you on the spot for that too.

With all the lack of personal responsibility nowadays, I'm sure it's only a matter of time until someone challenges employer policy in court and wins. But as the law stands now, there's nothing saying an employer can't let you go for a positive drug test, whether that drug is legal or not. Best way I can see around it, is an employee would have to treat it like any other prescribed drug. They would have to notify the employer that it has been used outside of work hours and is not impairing them in any way. Employer can then make a call as to whether that person should be on light duty or something. But even then that would still require a prescription.
