    Default Help/ FL: Getting sued by WCB, looking for lawyer

    Hi,

    My sister is getting sued by WCB for an accident 2 years ago. She went to the police and the police refused to take a statement as the damage was below the threshold. Also claims were filed to the insurance company to deal with the other party.

    Fast forward to today, she is being sued by WCB for alleged wages lost and future income, about ~100k. Her insurance is refusing to take on the case. I find it strange that the claims were made to WCB claim and not from her insurance company. I think they are fishing, but who knows.

    Does anyone have experience with this kind of thing? Also it would be greatly appreciated if anyone has a lawyer they can recommend.

    You mean to say the other party involved in the accident was 'working' at the time and it turned into a WCB debacle?

    I think you're probably correct, 2 year limit or something like that, other party was not at fault but was working thus WCB's involvement because they've most likely been paying for that person's wage and now possible future lost wages. It does seem odd though that the OP's sister's insurance company has walked away from this, something just smells amiss.

    Ya her insurance company is responsible if wcb is suing her for someone else's injury as a result of a crash she caused.

    yes, the other party is claiming wcb. it is very strange as there were no claims made against my sister's insurance for 2 years. now all of a sudden, there is an wcb suit.

    i asked for more details, it seems like the insurance rep was the one that said they are no responsible for the suit, but I asked my sister to escalate it to the main point of claims in the insurance, they are now looking into it. I think the insurance rep thought they werent responsible because they had "closed the case/ claim number" on the file.

    If your sister was also working, her personal insurance may say it's not their problem wanting her company's insurance to clean it up. Maybe??

    If that's the case, it's her business insurance that covers this.

    You need her Insurance company to handle this.

    No, thats not how it works. Bill has articulated on here many times that many people wait until the final weeks until year 2 after the crash (last time to claim injury) and then throw a suit as a hail mary gesture of bad faith.

    If the accident wasn't even sufficient to trigger a cps paperwork, the whole thing smells like BS.

    However, your insurance company should be handling it anyway. They are the ones who F'd up. Change your agent of contact there or escalate.

    I have hard time thinking it's an illegitimate claim if WCB is behind it.

    They are insurance just like everyone else and wouldn't be pursuing a fraudulent claim because they wouldn't have approved it in the first place.
