    Yea thats a little more complicated that just 'biker hits jay walkers and jaywalkers win'. The Judge seemed to indicated that the biker was malicious in their intention to hit the peds.

    Had the peds literally jumped out on the road in front of this guy with no chance of avoiding, they would have gotten 0$. The fact that the biker had time and space to avoid them is what the judge admonished.

    I dont think 25% fault is inappropriate for this scenario. However I think 100,000$ certainly is. A cap definitely needs to be in place for things like this.

    bc is out of control for accident pay outs. Thought I read their doing a total revamp as they cant continue on the path they are.

    I think you guys are missing the BS here. He got $98k for WITNESSING his wife get hit. He didn't get hit himself, or injured.

    its bc. 400k to 500k settlements are the average out that way. Maybe the guy was legitimately traumatized?

    Other than not having to work, buddy probably broke even in terms of wages if he got 95k after 5 years of being off work (likely on long term disability if he was employed full time prior to this).

    If I had known BC was famous for frivolous insurance payouts, I would've tried to step in front of a few slow moving vehicles in Kelowna last weekend.

    Im certain that some people have done this - intentionally hurt themselves in a low speed injury to get out of work and hope for a payout.
