Default LeBron James’ ‘Taco Tuesday' trademark application denied

    https://finance.yahoo.com/news/lebro...085543573.html

“Techno Taco Tuesday” that proved to be a key piece in the downfall of James’ attempt to lock up the rights to Taco Tuesday.
The techno twist on the Tuesday was actually trademarked by a Las Vegas entertainment company back in 2018, specifically for the “advertising and marketing services” category for which James was seeking protection. As such, James’ application was denied for being “confusingly similar to the registered mark.”

Oh I see now, a Casino owner in Vegas can own "Techno Taco Tuesday" and by that logic, a BBaller can't own "Taco Tuesday" US trademark lulz.

I was kind of rooting for Lebron, just to see what he would do with it. I trust King James.

If there is one thing I would pay money for its a 69 cent taco Tuesday poster from the 80's.

Lawsuits to anyone utilizing the phrase in any of their marketing.

Glad he didn't get it, ridiculous to even try.

By the rationale that they specify though, I could trademark "Super Happy Fun Global Hyper Mega Net" And anyone who tried to trademark a couple words similarily should technically lose.

Just in case anyone is actually curious, you can't actually register just a word or a phrase. Trademarks are registered in specific classes of Goods and Services and you only have protecion within those classes. For example if I register 'Beyond Evolution' as a Car parts store. Technically speaking someone else could register "Beyond evolution" as a financial lending business. So long as the registrations don't overlap and won't cause confusion between the two businesses.

Here is the actual techno taco tuesday trademark:
    http://tmsearch.uspto.gov/bin/showfi...02:mdkpto.5.10

    It's registered in:
Goods and Services IC 035. US 100 101 102. G & S: Advertising, marketing and promotion services; Promoting the concerts of others; Promoting the shows, festivals, night club concert and events and dance party concerts and events for others; Promotional sponsorship of live music concerts, music festivals and party events; Advertising, marketing, and promoting the goods and services of others via the preparation and distribution of postcards and flyers, arranging advertising on radio, television, newspapers, magazines, and other print and digital media including online and social media, and the management of event ticketing for others. FIRST USE: 20140520. FIRST USE IN COMMERCE: 20140520

Because Lebron was trying to register Taco Tuesday in the same IC 035 category, it would cause confusion and infringe so it was denied.

But you can register it in other categories, for example here is 'Taco Tuesday' registered for downloadable audio/visual works and podcasts:
    http://tmsearch.uspto.gov/bin/showfi...802:mdkpto.5.1

This one is for small electrical appliances:
    http://tmsearch.uspto.gov/bin/showfi...802:mdkpto.5.2

This one is for gambling machines:
    http://tmsearch.uspto.gov/bin/showfi...802:mdkpto.5.5

Fun Fact: No one has Taco Thursdays registered. You'd think someone would eventually try another day of the week.

The one that I've been following is "pwnage" which did go through just last year. There was a different company that tried a decade ago, and for whatever reason, did not get approval.

pwnage being one of the original internet memes, long before millennials even were born.

God may have rested on the seventh day, but that's because he was still tired and hungover from day two tacos and margaritas.
