My client blew .07 but the a rookie cop still charged her with impaired driving. That was a one-off cross that is shown in movies - after I was done the cop was so embarrassed. Admitted to being a rookie at the time, not taking proper notes and testifying how my client was behaving so belligerently and smelt like booze so had to be impaired. After I was done my cross with her, the Crown just dismissed the charge. So that's my long way of saying perhaps you saved yourself a lot of embarassment by not testifying.

    Just depends on a specific situation. If the person is so bad that they are endangering lives then yes you should testify. But if it's situation where the person MAY have been drinking and are sitting in their in a parking lot and not actively driving (like my client) then maybe not.
    Your client blew .07 and they MAY have been drinking?

    0.08 is impaired according to the law. He said nothing about his client not drinking. Just not impaired.

    Funnily enough, during this specific cross as I was going perhaps a little too hard the judge interrupts the flow of my cross saying 'please be respectful' at one point. I almost blew my lid at the judge and said last I checked this was an adversarial process and I am duty bound towards my client to do an effective cross. But probably a good thing I didn't say anything in response and continued onwards. lol

    ^ Yup still adjourned. Of course they made the trial date for when I'm gone working. Gave them my dates for when I'm available but they were shot down every time because the 'officer isn't available'. Filed a forward of adjournment (I think that's what it's called) last week. Have to go in front of a judge mid next month to get the trial date changed so I can attend. May or may not be granted.

    Wow what a saga this is turning out to be. Went thru all the motions to get the trial date changed. Trial is tomorrow but figured I'd better start making some phone calls to see if it's going ahead. Crown office couldn't tell me anything. Sounds like they're getting put thru the ringer there. Had to call the RD court house and they just said nothing is going ahead and it is unknown when it will be. She seemed unsure tho.

    I feel like I should still go to make sure tho. I dunno.

    Update:

    As per above, I decided I better show up just in case something needed to happen. I was the only person there. Waited around to see if the witness would show but she didn't. Didn't really matter tho as the Courts had already decided to push all trials down the road due to COVID outbreak. Mine was pushed again for few more months as of now. They are unsure if the date set will actually go ahead. Time will tell.

    No more traffic court for the time being.

    Update:

    Alberta courts released their stage 1 resumption plan which covers the dates of May 25th to July 3rd. Traffic court is not scheduled to resume within stage 1. Unfortunately, my trial is within this window. It will be 'presumptively adjourned for six weeks and rescheduled at a later date.'

    Bummer as I was hoping for a conclusion early next month. Oh well, the saga continues.

    I dont remember exactly whats going on here but if they cant prove it was you operating your bike shouldn't it be a registered owners ticket with no demerits?
