True. VietCong mean business! I'd bet on them to actually beat this.

    Update:

No go. Trial was set for Aug. 17th. They are adjourning all trials again. No idea what the new date will be. Got confirmation from the Red Deer provincial courthouse today after contacting them last night. I have been keeping an eye on the Alberta Courts COVID page and saw that they recently changed it.

I was told to reach out directly to the Crown Prosecutors office or wait until after the 17th. A new date will be available some time after that.

Getting a little ridiculous. Wish they just accommodated my original trial date of March 4th, before all the Covid took over.

Well after a year they just throw it out because you didn't get a speedy trial.

I have heard about this in the past buy I haven't dug into it. Is that how it's supposed to work? Should I email the Crown and just say 'Hey, withdraw this because I didn't get a speedy trial.' ? lol. The dates here are now so fucked up, I don't see how the witness is going to show, especially now that they are starting schools back up.

This is from 20 years ago, but they just sent me a letter and said it’s withdrawn. I had reserved plea twice, then finally set not guilty. I dunno what happened next, but I’m guessing the cop wasn’t available at the court date for whatever reason, and the next date set was past 1 year so they just withdrew it.

Delay as long as you can, judge is going to think how ridiculous it will be when it ends up being an event 2+ years ago

As much as I want lane splitting in Canada, doing it without the public backing you (as in California) is a bad idea.

I agree with all the reasons it makes sense, but the argument of improved safety is diminished when the average driver isn't expecting this behavior, and doesn't accommodate accordingly.

In California, and Europe, I often found drivers would create space for me to filter and split. In those places, the average driver is aware of and actively accommodating bikes moving between traffic. That isn't happening in Canada, and you're more likely to create animosity than anything else. We don't need more Snowcats tainting the publics perception of motorcycling.

Good luck, and I hope you can beat the ticket!

Yeah driving around France all the time, people always make room where there is traffic congestion for bikes to filter by. It makes sense too as everyone wins. Less lines in back and it doesn't hold up traffic in front. People here are so narrow minded in the "I am in line so you need to be too" thinking.

I was making a joke guys, I don't think there is really that much debate about splitting lanes. Too bad the OP probably won't get his day in court to try and change the case law in canada, although, his chances of actually doing that were nearly zero anyway . . . .

There just needs to be an education campaign over the benefits of filtering for vulnerable road users (motorcyclists, moped users, cyclists) to get the ball rolling. Get AMSS and AB Transporatation together to do it. Cyclists have it easy here... they already get to filter without issue but if a motorbike does it, suddenly there is hell to pay.

Yah I was really looking forward to doing this. I really wanted to cross examine the witness here. Have to wait and see what happens I guess.

Good luck with an education campaign. We haven’t even gotten people to accept zipper merge FFS.

Lol. Yeah, no one rages at cyclists who lane filter. Nope.

I think the difference is that cyclists cause traffic slow downs, especially when leaving a light etc while motorcycles generally zip up to speed quicker. However the rage is real!

I can't argue that, I just think it's funny that he thinks everyone is cool with cyclists doing it and they "have it easy".
