    Our “legal framework” doesn’t have any teeth for restrictions under public health emergencies?

    Way I see it, we have 4-5000 real police officers in this province. We issue around 300 speeding tickets between 0 and 15kph over a day.

    We have some capacity to issue some meaningful numbers of pandemic fines. We just aren’t.

    Canada doesn’t know anything else but riding the waves of restrictions and reopenings. Wave three Canada wide has been crickets on dead people, but countrywide politicians freak out over cases. It’s like they don’t want healthcare workers to do the jobs they studied and signed up for. Our healthcare system is a joke yet Canadians think it’s some utopian free heaven compared to everyone else. No one in the US flocks to Canada to get treatment.

    Tickets are getting written, the Crown is withdrawing them before they get to court. It also seems that the solicitor general is saying don’t ticket every single infraction, just go after the problem areas. Sounds like justice doesn’t want the court system clogged with $100 mask tickets and the prosecutors have issues around being able to secure a conviction for the ones being written or around the actual violation/health order itself.

    Like it or not, every single person who is ticketed is allowed their day in court. If the police go absolutely ham on ticketing, they courts would be clogged for ages and the knock down effect is other cases get delayed or at risk of a Jordan application

    Not with that pesky Charter in the way.

    Speeding tickets might be completely immoral and a net negative effect on traffic safety, but they do unfortunately fit with our legal framework.

    I'm sure the capacity is there to issue fines, but with no reasonable expectation of conviction they probably feel more inclined to deploy revenue collecting assets on the highway with a radar gun. There is likely still an argument to be made for issuing covid fines though, as many people would just pay them out of sheer ignorance.

    Outdoor activities
    All outdoor sports and recreation activities are prohibited, except with members of your household, or your two close contacts if you live alone. This includes:
    all group physical activities, such as team sports, fitness classes, training sessions
    all one-on-one lessons and training activities
    all practices, training and games
    Outdoor recreation facilities can remain open unless specifically closed by public health order.

    Bulk court dates for same convictions from same officer on same day. Play the body cam footage. You were there, no mask, conviction! Done.

    This is fucking easier than conviction on a photo radar ticket. Photo radar could actually be inaccurate, etc. This is an "I seen him" moment.

    Put that cash all in to CYBN, hand out proceeds towards the small business bail out fund.
    Look like a hero.
    Hell, wait until election time to hand that money back out.
    Double down on hero status.

    Logistically, that's a nightmare because now you're packing in a bunch of hearings into a single room which then becomes an obvious "gotcha" moment when the hypocrisy gets pointed out. There's a catch-22 of:
    1) Make the fines small enough that the significant portion of people just pay the damn thing since there's no real repercussions (like a photo radar ticket); or
    2) Make the fines big enough that the Crown is more willing to fight it, but it will, in turn, encourage more people to fight it because it would cost a lot more.

    Ultimately, ticketing everyone means putting a strain on a system that is already limited in its ability to handle capacity. It's basically what's happening to the healthcare system now.

    There's also a small part of me that feels pretty bad for Kenney. He's dead man walking from a political standpoint.

    Instituting more restrictions, regardless of the purpose, is going to cause him to lose what's left of his base, which, at this point, probably aren't many. But will won't gain him any pro-restriction support because they hate him for everything else.

    He has no right move politically and basically everyone is chomping at the bit for the next election.

    Who said anything about ticketing everyone? You make an example out of just enough people to get everyone else in line.

    $2000 dollar fine for violating health regulations. Do what Quebec did and issue a few hundred of those a day until people smarten up.

    Repeat offender? See how much they like a couple nights at the remand center.
