    All I can say is good luck, I had a motorbike stolen some 34 years ago. Guy didn't get far as he didn't make the corner from WB McKnight onto SB John Laurie and ended up totalling my bike. I went to court to try to recoup costs including the value of the motorbike and the judge looked at me and said to me to just look at the fine upstanding individual who stole your motorbike, do you think you'll get one red cent from him if a judgement were to come down against him that included restitution. The guy had been in and out of jail his whole adult life and had never held down a regular job. I suppose the only positive I walked away with from this was the fact that he broke both of his femurs when he wiped out, served him right.

    The simple fact remains is that you're chasing the pot of gold at the end of the rainbow, go see a movie as ES suggested or go for wings with him at the upcoming beyond foodie meet.

    Culprit isn’t a hardened criminal by any means. Office contested to this- he was baffled how this “kid” a very young adult got into this situation. As I stated - I would like to recover but I would also like to teach a lesson or hopefully have some lasting impact on this guy if I cannot.

    It doesn’t sound like there is a ton of options for free or reasonably priced legal advice out there to help me move in the right direction. I will just try to proceed with the small amount of knowledge I already have with civil suits I guess!

    Small claims for restitution.

    Was he charged criminally? That's more damaging than a judgement in civil court.

    even with basic insuarnce, it would still have Fire and Theft coverage, unless you specifically declined those riders. Every insurance policy I have ever had had the F&T rider added to it automatically. If you did decline it, well, that's on you.

    Teach him a lesson? What lesson are you going to teach him that he is not already going through?

    There's no way that wasting your time in civil court is going to teach this person a valuable lesson (esp if he's already getting charged).

    no, Liability is only to cover the other parties when you're at fault, fire and theft is part of comprehensive, which is not to be confused with collision.

    The most surprising thing to me is that he was caught - did he drive right into a police station or something?

    Anyways, sorry this happened to you. Yet another advantage to leasing haha.

    I am no legal expert, but good luck getting a penny from this deadbeat. Probably best to use insurance for damages and move on.

    wow - so many arent getting the point here from the OP

    He wants to teach the perp a life lesson - assuming its not going to cost him 10,000$ in court fees.

    OP definitely go the small claims route. Most of these types of (low life) cases the accused is a no show and the judge will summarily rule in your favour.

    This does mean paperwork an filing fees - as well as your time. A rough guess - about 1000$ in fees for everything?

    Once you have a settlement in your favour, you still have to go through the financial judgement route, which is also long and drawn out.

    Could be 1-2 years to close.

    I don't think anyone is missing the point.

    The sentiment is that taking some deadbeat to court isn't likely going to result in a profound awakening for him, but it will certainly cost OP a bunch of time/headache/money. It's simply a no-win situation.

    Most lawyers offer a free consultation, I'd start there for advice on how best to proceed.

    This. I think everyone understands. Seems like most people are telling the OP he won't get blood from a stone.

    My parents have 3 separate judgements spanning almost a decade against people who are presumably better off than this car thief (employed people with rental property payment defaults), and they still haven't seen a dime (never will).

    You're not going to teach this kid a lesson by costing yourself a bunch of time/money in court.

    it's amazing how few people have a back bone when it comes to holding people accountable. I think the op should make a point and file the small claims. It's simple and easy and he will win. It's a minor expense on his end.

    It will accomplish what hes hoping for.
