Default Speeding Ticket Notice Picture Question - Considering Court Appearance

Hey everyone! I just have a question and seeking advice.

Today, my wife got a speeding ticket (photo radar) in Deerfoot having a speed of 118 km/hr. I was the driver; the vehicle is just registered on her name.

Anyway, the notice shows 2 pictures; but both pictures (including the zoomed picture) is totally black. It does not show her plate number and literally can only see the contour of the tail lights of her car (on the un-zoomed picture).

I had a ticket before and just paid it. It was quite obvious on my ticket though as the picture showed my plate number. This one is totally black. There is probably a way that they can "enhance" the picture but I am totally not sure. If there's such process, I'm surprised they did not put those "enhanced pictures" to show her plate number on the notice letter.

I guess my question is, there is a number on the notice that I can call if we think it is not our car. Honestly, I don't know if it's our car. I just remember we went thru Deerfoot a couple of weeks ago and just basing it to that fact. Should I just call this number?

The other option is just present my case on the court where I will just show them the notice; the black pictures and ask how can they prove it's our vehicle if the pictures do not show any license plates. I will represent my wife as she's pregnant and will be 9 months on scheduled court date lol.

    Thanks everyone in advance.

So, you did it, and they had a good enough photo to pin it to you,

But you think you are going to convince a judge they were wrong?

It’s RO. Pay the fine and move on with your life.

Or go to court and try to prove lane splitting is legal or something I dunno what your time is worth.

If I’m paying for a picture I think I’m entitled to a good quality picture. That’s my opinion lol.

Sounds like they removed the ambiguity delete button (if the photo didnt show a clear plate) option from the special constable on the roadside, and just left it up to the victim to call in complain - which I would do in your case if the plate is NOT legible.

How did they know to send you the ticket if they couldn't read your plate? They had to have seen it somehow.

It says right on the ticket that the photo in the mail does not represent the original photo quality. You're gonna go down to the courthouse, review the original photo, see that it's a high quality shot that details everything necessary to give you a ticket, and that'll be the end of your day.

Take it as far as possible and have some fun while doing so!!!! Don't hand over your money without pushing back!!!

No need to defund the police.... just the traffic enforcement section. lol

Didn't see the Sheriffs in the government layoff articles today of course.

We obviously did not know this offence until the letter came. I only confirm I am driving as my wife never drives when I am around. Refer to pic below.

Anyway, as an update, I called the number today and got a call back from a constable. He also can barely see the plate number on the original picture from their files therefore, have withdrawn this ticket. All our friends basically said to fight it but call the number first before going for trial of which, good thing, I did.

They are now playing the 'let the victim tell us if we are wrong' - card. No doubt EPS did it and saw a bump in ticket revenue as many people (as per this thread) will just pay the fine without question.

Excellent!!!!! Now, you need to ensure it gets withdrawn correctly. Get something in writing. email or something. Believe me, you need something in writing. You are dealing with incompetent people here. Protect yourself from a potentially nasty surprise come reg. renewal.

Yes, absolutely. That is what I am waiting now. The constable said he is sending the withdrawal letter but it will take a couple weeks to arrive. Keeping this ticket until that confirmation arrives.

That picture they sent you is laughable, but my question is: how did you even get the ticket in the first place? If upon review they could not tell, how is this even a thing? Is there an AI that auto-detects plates and sends out the ticket?

They should just send this picture to every registered plate in Alberta. I'm sure the majority of people would just pay it.
