What I read was that RBR has 'appealed' the penalty that was given to Ham and both drivers/team bosses will need to present themselves to argue their sides. Being that RBR are a bunch of sissy whiners, I am not surprised.
No. This is just a hearing to present new evidence, and if there is new evidence that wasn’t available to the stewards at the time of the original event (regardless if it was used), then the investigation can be reopened. This was invoked twice recently. The recent one was last year where ham passed a yellow flag light during qualifying. The new evidence was RBR using up a filming day, having Albon drive the RBR car on test tires at the same speed and lines as Hamilton to prove that Hamilton purposely rammed Max.
Mercedes only released a short statement that accused RBR management of tarnishing the sporting integrity of Hamilton.

The funniest thing of this is that Albon was interviewed right after the race and he stated that it was a racing incident in his opinion. He also said Max should not have left that much room to the inside either so he gave Hamilton the opening. Haha.
