    Default Insurance question, paging Mr. Bandit, or others...

    So does not apply to me at all. Just a question I had after watching some YT videos.

    So, buddy steals a vehicle, and leads police on a high speed persuit. Cops decide to PIT the guy, and during the maneuver, it causes the stolen vehicle to crash into you while you are driving to work. They arrest the guy, but you have a damaged vehicle. Who pays for your wrecked ride? I figure if you have full coverage your insurance pays out and whatever, but what if you just have PLPD?

    Can the police force be held liable at all? or are you stuck with suing the criminal and never seeing a dime and fixing it yourself?

    Inquiring minds want to know. Paging @Masked Bandit

    Figured more than I would like to know, hence the post.

    I'm pretty sure I buy extra insurance that covers me from being hit by an under/uninsured motorist. It's a thing that's available.

    Yeah coverage for uninsured motorist is a thing. Don't think the cops are liable, unless it's thier vehicle that hits you.

    If their actions physically cause a vehicle to hit you (pit) I don’t see how they wouldn’t be liable.

    Sounds like the kind of thing that would be sorted out in court, rather than some standard administrative insurance policy situation, and I can’t imagine it would shine favourably on them.

    I’m no lawyer but seems like vicarious liability would definitely have some consideration in outcome here, and it’s pretty common to go after less responsible parties for damages that are flush but “less” responsible for the outcome. My guess is cops would just pay (their own insurance) and chalk it up to the “cost of doing business”.

    You're essentially shit out of luck. The cops aren't going to pay and once the vehicle is stolen the legitimate owner isn't liable either (more accurately their insurance company). It's like a hit & run at this point, if you have collision coverage on your policy then your company will take care of it less your deductible and it registers as a not at fault claim.

    For a clusterfuck like that, at least you can still get it fixed for the price of a deductible.

    I kinda suspected that might be the answer, however, it was the police-induced pit maneuver that caused the wreck which was throwing a wrench into my thoughts because the wreck might not have happened if the police didn't induce it... Hence me wondering if they might be liable in that case. Some sort of gross negligence or something where there would be a world that they could be held accountable.

    Will Smith is the worst thing to ever happen to acting or Hollywood. Martin Lawrence is a close third. That clip is the most of that franchise I've ever watched.

    Id say you are shit out of luck. Though you only have third party, still check in with them on this incident. Most likely your insurance (say insurer A) will not not provide you with help or advice. At the very most, they will ask you to contact the stolen vehicles' insurer (say insurer B).

    Insurer B will inform you that their insured (car owner) is not liable for the damages caused. They may ask you for police report and supporting evidence proving the insured policy holder is liable.

    At the very end, youll end up going to court (spending time and more money) trying to salvage your losses. Sue all 3 parties and hope for a settlement.
