    Default Neighbor running power on my property?

    Odd question, I'm building a garage and the guy doing the excavation discovered my neighbor has a trenched power line going from their property, onto mine, then back into theirs for their shed

    Is this allowed?

    If the owner during the time the power line was trenched in allowed it, then yes. It's an easement. Check the title.

    If your place a weird shape or something, or does his zigzag onto your property and than back off? Or is it near the property line?

    I'd think that it's more normal to feed secondary buildings with lines that stay inside the same property. No idea what the laws say about it. I mean, you should be allowed to trench all around on your property with impunity, I'd think unless there is an easement or anything. Did you ask the neighbor?

    No weird shape, not cutting a corner, it’s a good 1.5’ inside my property line running parallel

    Nothing on the title has this information that I’ve seen

    Other problem it’s in the direct way of the garage pad

    if it's not on title, I think you can force the neighbor to move it. you really should start with talking to them though, as I suspect any legal means of forcing them would take a year or more . . .

    I think most excavations companies would be hesitant to dig up a live electrical line on purpose.

    If it's only 1.5' into your property, you won't end up pouring a pad over it, as minimum setback requirements are 2' (in calgary, at least), but I guess it's likely still in the way while you prep the pad and pour your footing.

    Honestly, it's probably the BEST time for your neighbour to learn of this bad news, since you already have a machine on site. Perhaps your neighbour can strike a deal to get your excavator guy to trench out a more appropriate place in their yard?

    It may have been buried without a permit when the property was vacant and if you call him on it and it needs to be moved, he may be on the hook to get it redone and get it permitted. I would make every effort not to be a dick, but at the same time you gotta be careful in case you accidentally cut his power or something like that and you have him permission or whatever there may be some liability on your part.

    It sucks being in a shitty situation with a neighbour and a feud develops so avoiding that is never bad, but you absolutely want to make sure your ass is covered.

    It looked awful iMO...
    I'm open to being wrong about the exact details or the name of the hood, but I think that's what the realtor told us. I don't understand how or why this could be when it's within CoC.
