    Default Selling home, buyer claims new issue at pre possession walk through, need opinions.

    So I’ve sold my home and possession is Friday. It’s be unoccupied since April 2nd, the home inspection was done Tuesday May 4th and the only “issue” noted was “low” water flow in the showers (knew it would be the restrictors in the head that were gummed up). I agreed to have a plumber inspect and repair at my expense which I did and provided a receipt for (removed restrictors and cleaned shower heads). Now as of tonight they have done their pre possession walk through and are claiming the bath faucet is leaking and causing low water flow, which has never been mentioned whether in writing or not to me or my realtor, and they want me to pay for a plumber to come again to rectify their own “diagnosis” a second time. Not only is this potentially going to cost more money but also I’m going to lose pay yet again to take time off to meet a plumber if I agree to do it. It’s not in writing on the contract and the original amendment states that a plumber would inspect and repair as they find necessary for low water flow from shower heads.

    WWBD? Both myself and the realtor feel they can either take it up with the plumbing company themselves after possession as they have a receipt for work done and nothing in writing stating they found a leak at the home inspection, or accept they have their own issue they did not put in writing when finalizing the sale. Are we wrong?

    You had a contract stating an issue they want fixed prior to possession.

    You followed through and can provide a receipt. Your end of the bargain is done.

    Tell them to pound sand.

    That was very generous of you to fix the initial problem.

    Standard home sale contract says "as is". It's fucking theirs now.

    Pull it and re-list. Call their bluff and sting them $2k for it.

    at this point, if it is not in the contract, it's not your problem. You fixed the showers and provided proof. If there is nothing in the contract about the faucets, well, that is on them. However, if there is a material change in the condition of the faucets since the time of the purchase contract, they may ask for it to be repaired, or it gives them the option to back out.

    Really, it comes down to this. Do you want to re-list it? Will you make more? is it worth your time? IIRC, your past posts say you just want to be done with it and move on. If I were in your shoes, I would offer to split that cost with them and see where that leads, otherwise, decide if it's worth your headache.

    As always extra slow wins internet. That's why he's the big dog around here. I faced a similar situation with dog smell in my house. I had it written into the contract that professional cleaning was to be done in this house. Once it was completed the minor dog smell was still there. & I still bought the house.
    0.1% of purchase price is not a deal breaker. Fuck these clowns.

    If they are going to walk away because of a slight leaking tap that's retarded. They're just getting you to pay for as much as they can before they take possession. We had a buyer do something similar complained about something that was a non-issue and wanted $$ reimbursement and this like was 3-5k. Told them that it's a non issue and if they didn't want it we had other offers.

    Thanks, you guys kind of echo my sentiment. Feels like the buyer is trying to squeeze as much out of me as possible and I’m done making concessions. I’ve already negotiated down roughly $3500 on things they wanted taken care of which were mostly wastes of my own money and time so we’ve told them ive filled all contractual obligations now and the rest is their problem.

    Your realtor not giving you advice on this stuff? Not pushing back for you? If so, that's brutal service and you should use someone else next time. Or you selling without a realtor? That's a reasonable choice in this market, and these hassles are probably worth the savings.

    He’s been ok, some of it probably had to be done to not kill the deal but some of the smaller stuff probably should have just been their problem as now it’s causing this shit. First time selling so I’m learning a lot.

    Tell them to fuck off... When I sold my home in Airdrie they tried the same kind of crap. Told them to pound sand and they gave up. Anyone who is willing to walk on something like that has bigger issues than the cost of a faucet.

    At this point they can't walk away anyway, the deal is done, best they can do is take you to small claims and it wont be worth their time for a few hundred bucks.

    This is exactly what I thought. The equivalent of a Facebook Market or Kijiji buyer agreeing on the price and then saying they didn't bring enough cash with them. Fuck em!

    Sure they can. They can walk away any time up until the money is in OPs wallet. It's just a matter of how much headache it's going to be for everyone if they walk away at the final stages of the process.
