The real problem is that it isn't going to be an "error". This is going to lead to straight up corruption by the police. Police already routinely throw unjustified charges at people just for the sake of creating a problem for them, and working under the assumption that at least a few of the charges will stick. Now they are eliminating a way to fight your case when you've been wrongly charged. They can legitimately pull you over doing 10 UNDER the speed limit, and just hand you a ticket for 30 OVER the limit.
