    Default Rear Ended: Insurance Question

    Kids car was rear ended by a guy who didn't want to deal with insurance and offered to pay out of pocket for damages.

    No problem I said let's get some quotes. Our quotes were in the 2000 and up range which of course guy doesn't want to pay. Some shady repair place offers to do it for half the price or less which we are not willing to use. Offered simple cash settlement but the guy keeps low balling and to be quite frank has pissed me off now.

    Obvious choice is to deal with Insurance to avoid the headache of dealing with this person.

    My question relates to how the insurance company will handle things. My assumption is the insurance company will write the car off as it's a 15 yr old vehicle for the kids first car that he bought from a family member. It was the perfect car what he needs/wants.

    If insurance gets involved and they determine they'd prefer to write it off are we forced into accepting this?

    Haven't dealt with a scenario like this. I want the other driver held accountable but don't want the car written off as the outcome.

    If they write it off, take the money and then offer to buy it back from them?

    If hes being a dick, dont waste your time and just get insurance involved.

    As for the vehicle, if they do write it off. It probably wont be worth it to buy it back as you have to pay to repair it AND it'll have a salvage status.

    Just move on and buy something else.

    Go with insurance. Its their job to deal with this headache.

    The insurance company will assess the vehicle. If will either be written off, or you will get a payout for the damage and keep the vehicle.

    There's an expression for this... I just can't quite recall its origin, at this specific juncture...
    The guy who hit my kids car wants to use a shady repair place that's 70% cheaper than the 3 different places we brought the car to. Offered an extremely reasonable cash settlement that hes refusing.

    Only reason I tried to work with the guy to avoid insurance was he seemed concerned about the accident being on his driving record. I assume he drives for a living.

    Always go through insurance, the other guy's driving record is not your problem.

    I don't get why people always feel they need to play nice in these situations.

    Don't be a bleeding heart and go through insurance to protect you.

    People like to pull this shit for reasons like they already have high premiums from previous accidents, don't have insurance or many other reasons.

    I have a hard time thinking of a situation where I wouldn’t just throw the keys at insurance over a situation like this.

    This is what I did last time I was in this position, and it worked (although I gave him a day to respond). His company did some painting in a parkade and got overspray on my entire car; since it was biz insurance, he really didn't want to have a claim, so when I gave him a deadline he became very responsive.

    The solution to issues dealing with a cheap ass is to not deal with a cheap ass. It's a separate problem whether you want to keep the car or not.

    Off insurance only works if both parties are being reasonable.

    My son dinged another car leaving his high school one day. Totally his fault.
    The mom didn't want to go through insurance either So I agreed to pay for the repairs.

    However I let her pick the place and didn't argue the cost. I paid the body shop directly and all was good.

    This guy doesn't want to do that.

    Get insurance involved before he does...

    Give him a deadline and get all your corresponding messages/emails together as evidence. Don't forget to get a police report, wasn't sure if you had one already.

    You guys are missing the point here. The question isn't whether or not he should be going through insurance. It's whether or not he has to accept the write off.

    I don't believe you have to accept it.

    But if you do and you want to keep the vehicle, it must be repaired before you can drive it again and it will have a salvage status, but since it's a beater that's not that big of a deal.

    I would suggest starting to look for vehicles of the similar year, mileage, options, etc on Kijiji, Facebook, and Auto Trade and taking screenshots of them. The insurance company will undoubtedly give you a low ball offer, so have some examples for them to counter their offer should you go the insurance settlement route.

    The current crazy car market makes this an excellent time to have a car written off

    I don't believe you have to accept it.

    Generally if you go this route the vehicle ends up in a salvage state and you can only put PL/PD on it.

    Cars that can be written off with minor fender-benders are cars that you probably shouldn't be too worried about writing off. A beater being written off can be a huge financial benefit.
