    This is probably the best thing that could have happened for the Democrats in terms of getting votes in the midterms. They will still lose, but maybe not as bad as they would have without this decision.

    Ironically, the same interpretation that they used to overturn Roe v Wade is the interpretation that can be used to also overturn interracial marriage in Loving v Virginia, a case that Thomas conveniently left out in his concurring opinion, despite also stating that marriage equality in Obergefell, contraception in Griswold and same-sex relationships in Lawrence, were likely to be reexamined next.

    Addition:
    The most concerning thing about their decision is their position that, because abortion wasn't a stated right in their Constitution, it is therefore not a right at all. That there are SCOTUS judges that are taking literal interpretations of a 300+ year-old document is extraordinarily concerning. While the Canadian Charter is comparatively much younger than the American Constitution, the SCC has long decided that the Charter is a "Living Tree" that can adapt and expand to accommodate evolving definitions during the modern era. SCOTUS seems to be doing the exact opposite.

    While widely claimed on social media to dunk on Thomas, that's not exactly accurate.

    Loving v Virginia was decided primarily based on the Equal Protection Clause (a state cannot “deny to any person within its jurisdiction the equal protection of the laws”), while Roe v Wade / Obergefell / Griswold / Lawrence were Due Process (a state cannot deprive “any person of life, liberty, or property, without due process of law.”) based. Same Amendment, but based on very distinct clauses thereof.

    The Supreme Court of Canada rewriting the constitution with a bias to presentism for whatever direction the wind is blowing at the time is the biggest mockery of constitutional law that has ever been contemplated.

    It’s a complete joke and pretending it’s not is a scary mentality.

    Canada basically doesn’t have a constitution under the stewardship of the current slate of Supreme Court judges.
