    Default What do you call an agreement not to sue?

    Wife knocked someone’s mirror today, got out and saw it was cracked. She left him a note saying she did it, and he just texted her asking for $300 to fix.

    No idea what a tiny mirror on an f150 tow mirror runs, but not really wanting to drag it out, $300 seems like it could be worse. My question is what do you call an agreement or letter we can get him to sign so he doesnt come back later and say we owe more, or that he wants to go through insurance after we pay him?

    Im assuming theres some form lette, or template out there you can use for this kind of situation.

    TBH seems like a good use of the memo line on a cheque “ Compensation for damaged right mirror ”

    It doesn't require a title.

    I _______ admit fault in damaging the mirror of a F150 belonging to __________. He agreed to $300 compensation to repair the damage, and agrees any and complete compensation for said damage is now paid for in full.

    I would think so long as you have proof of an agreement in the form of an e-mail, texting, written letter etc you should be good. Nowadays it seems that stuff holds water in court. I would write a cheque though that states it is settlement in full for damage of XXXX vehicle in them memo line as Killy says and he cashes it, you have proof he accepted it.

    If it is power folding extending mirror they are 1500 ea , so 300 is cheap…

    Yep all of the above is good advice, and $300 you take and run.

    I did something similar 10-15yrs ago, left a note, and the guy was so thankful that someone actually left the note that he went and scouted a mirror, did the install himself, and just asked me for the cost of the mirror. I think I added another $50 for a case of beer for his time to install and we called it a day.

    I can't even remember the actual wording we used but it was along the lines of what was suggested above - this money is to cover this damage in full, both agreed. We sent it electronically, never even met in person, and never heard from him again.

    Isn't this an Indemnity agreement? At the end of the day I don't think you need to go that far. Little quick piece of paper like @Kloubek said or the memo line in a cheque should be good like others have mentioned.

    You should also be able to see the cashed cheque in your banking app, download that pic for a bit more peace of mind.

    Yeah this happened to me too on a narrow street in the dark down in Prestwick area years ago, it was a F250/350 with the mirrors extended and I clipped one of them. I went door to door until I found the owner and he told me not to worry about it, because it was not the first time someone had smashed it but I was the first one to actually own up to it. Dropped off a 24 pack as a thank you right after.
