    Question can my boss do this???

    hey just a quick question...

    everyday i work from 8-5....i get 2 15 min breaks and a half hour lunch....and we can only book for 8 hours, even though we are there for 9 hours...do any of those breaks have to be paid breaks? i searched the labour laws and stuff and i couldn't find anything on it...but me and a couple of co workers have been discussing it and none of us think that it's right....

    any help would be very much appreciated!

    because i'm sure that someone on here can help me with this shit...

    I used to work 8-4:30 at Stantec, thats 8.5 hours, lunch is .5 hours. I think you are suppose to get paid for break.

    you should be paid for your 15 minute break... but for lunch you are on your own.

    if you are there for 9 hours, and take 1 hour in breaks (2x15 + 1x30) then you should be payed 8.5 hours.

    does anyone have any legal proof for this?? i am not saying that anyone is wrong, i just want to be able to go in and confront him with the legal documents.....make him pay the fuck up!

    edit: i just thought of how much it would be...

    $8/hr* 0.5 per day*5 days a week....

    that's 20 bucks a week....over a month= $80 +
    a year= $1040!!!

    i thought they had to pay for the 15's, but i got this from the human resources site

    During each shift in excess of five consecutive hours of work, an employee is entitled to at least a one-half hour break, except where it is unreasonable or impossible. The break can be paid, or unpaid, at the employer's discretion.

    This means that where a shift is less than 5 hours in length the employer is not obliged to provide a rest period. Where the shift is longer than 5 hours (e.g. 8 or 9 hours) the obligation of the employer is to provide at least 30 minutes of break time sometime during the shift. The 30 minutes can be taken in one unbroken period but may be provided as two 15-minute or three 10-minute breaks.

    This, of course, is the minimum standard, and in practice for a full day shift the amount of break time provided is frequently more than the specified minimum.

    yeah but no where there does it say that the 15 min breaks have to be paid....i need to find a document with that on it so that i can confront him....and not be like...well the guys on beyond said so!

    15 min breaks do not have to be paid, the employer just has to provide you with the break time. It would be similar to working 8-5 with a 1 hour unpaid lunch. The labour law doesn't state when the breaks must be. The workday is still 8 hours. Afraid there's nothing you can do.

    So that means that you are allowed to work through those breaks and get paid also I am guessing??

    Pretty sure the reason why the pay you is just incase there is a fire or something, you can help people out or what not, so if there ever is a fire and your on break..be like sorry not getting payed right now...and tell him 2 fuck off

    I work 10+ hours/ day and get 2 x 15 minute breaks. I can take an unpaid 30 if I want but I never do. I often end up working the entire 10-16 hours without stopping once. It sux when you're doing physical labour but it's a good job once you add in the overtime.

    Breaks aren't paid (its' up to the employer).

    And you can be forced to take your 30 minute break in 5 hours (because that's the law/standard). Legally, you shouldn't be able to skip that break.

    like said above, breaks arent paid. if he has you scheduled for 9 hrs, and you only get paid for 8 then he hasta give you 1 hr worth of breaks.

    labor law says that in a 8 hr shift they technically only hafta give you a 30 min break, if your getin 15's, those are curtosy breaks

    infamous, check the companys booklet or whatever, if it says u are going to be paid for ur 2 15min breaks.

    As long as you're provided a 30 min break for any shift over 5 hours, that's all the mployer has to do. They don't have to pay you for breaks.
