    Thumbs down i fucked my foot up! (wcb questions)

    hey just a quick question for anyone who might be able to help....

    i started a new construction job today, and a ladder slid out from under me and i went down with it. turns out that i fractured my foot, sprained my ankle, and tore some ligament in my foot. now when i was at the hospital, they asked me if it was work related and i said yes, and got the forms that i need. now here's the questions....

    1. will they base what i get from wcb off of what i would have made?
    2. do they look at all the hours that i would have worked, or do they just base if off of 8 hours a day?
    3. are there any qualifications that i need other than to have hurt myself to get wcb?
    4. how much does wcb cover? 80%?

    any help would be very much appreciated!!

    1 - yes
    2 depends how many hours your supposed to work per day.. 8 hours, 12 hours, 6 hours..
    3 - Nope, as long as your on payrole. i heared you have to be at a company for a certain amount of time, but i've filed for WCB in my first month when i worked in a warehouse. Just look into it to be sure..
    4 - no idea

    * were you wearing the proper clothing/equipment?*

    so how ya feeling? your injury's sound really painful, and would take a while to heal. It's sounding like your gonna be propped up in front of the computer for awhile...

    yes i was wearing proper safety equipment (hardhat and steeltoes) doctor said if i wasn't wearing steel toed boots that my whole foot would have been broken...

    ummm i feel like my foot is being hit with a hammer every second, and the doctor didn't even give me any painkillers! but yeah the doctor said 6 weeks no pressure on my foot at all.

    btw- i fucking hate crutches!

    the risks of working construction.

    i fucked up my wrist at work from overuse (insert jerking off joke here) but i was still able to work. the doctor basically told me "don't work any sort of labor jobs, get your education or you will see more and more injuries like this." not really a problem since i'm going back to school anyways, but i think the advice falls true for most.

    It was your first day on the job and you're going to file for WCB? I don't think you're going to be working there for very long. WCB premiums are so high, and any claim on the employer will jump their premiums. You might want to talk to your employer first, before filing a claim. I remember when I was working stucco and I asked my boss about WCB. They told me don't worry about it, I'd be fired before I hit the ground if I fell off the scaffold.

    ok, so if i am not going to get wcb, what am i supposed to do? i don't live at home, and i have bills to pay. the doctor said that i am not supposed to put ANY pressure on it for 6 weeks. what else am i supposed to do? go and live on the streets?

    i don't have any other choice as to what i can do. i can't work. and honestly, if i don't have a job by the time i can work again, well then i will use these 6 weeks that i can't do anything in to find another job.

    All I'm saying is talk to your employer first and see what they say. They may just pay you out instead of going through WCB, just so their premiums don't go up (think insurance). Either way, keep looking for another job.

    well yeah i did. and he didn't say much. he hung up on me at the end, and didn't sound too pleased.

    now would it be cheaper for him to pay me out instead of wcb? or how would that work? is it illegal for him to do that?

    i understand that having an employee file for wcb isn't good no matter which way you look at it. it sucks for me because i am stuck sitting here with a big ass cast on my foot, and having to use crutches whenever i have to go anywhere (i live on the third floor of my apartment ) and it sucks for him because of the fact that not only will he end up paying me for my time off, but he also has to cover the wages of whoever it takes to do what i was doing.

    You're crazy to ask your boss to pay you out. The system is there for times like this so I would advise you to use it.

    The injury has already been reported to WCB (it must be reported within 48 hours) and especially since your accident is severe like it is, you should never deny a WCB claim.

    For example, what if you cannot work for 3 months, you need continuous rehabilitation and your foot is fucked for life?

    Answer: Your boss is not going to pay for that. WCB will be there for you, even though they ARE a big pain in the butt.

    And yes WCB is 80% of your wages, but they dont take tax off so you almost get the entire wage you would have gotten.

    well, it doesn't sound like you are in his good books to say the least.

    i'd say claim wcb and start looking for a new job. atleast you have 6 weeks payed for to go job hunting.

    cool. now that i know that, i will just go through wcb. i didn't know what all of my options were. but yeah 6 weeks should be enough time to find another job

    one last question...does anyone know how long it takes to get wcb? like i was injured yesterday, and i have a whole bunch of bills due on the 15th. should i be looking for other ways to get money before then? or will the check(s) start coming before then? i am not sure as to how this works, but i figure that i had better ask now instead of later.

    Given your conversation with the boss, file for WCB, and look for a new job, you won't have one when you recover. Sucky situation, hope everything works out

    well whatever...i really don't care if i have a job by the time that this is all over. because if it took me an hour and a half on my first day to have an accident, it kinda makes me think about how safe the rest of the site is....

    but yeah i have to go and see a specialist on wednesday.....then i will know more info on how my foot is doing....it's very hard to change so suddenly...like i have never had to use crutches before, but now i have to. i am 6'3, 200 lbs, and apparently i look pretty funny because i am so big. on a brighter note, i was checking out my crutches this morning, and they are from AMG i wish that i had a camera to take pictures....

    File for WCB just in case you foot never heals properly. What if it takes longer than 6 weeks, what if it takes a year? Sometimes bones heal wrong and need to be broken and repositioned. anyway, just file it and don't worry what the boss says or thinks. But it's true, you have a 90% chance of loosing your job.

    They won't fire you as soon as you walk in, they'll prolly wait a few weeks..

    Your boss has a damn good reason to be pissed off at you. His premiums will go up by a substantial amount because you didn't know how to climb a ladder... and all for what? Your 90 minutes of contribution to the company? WCB premiums are a big part of any construction company's expenses, and it's cases like this that will piss off your boss and all your co-workers more than anything.

    Look at it this way: be happy that you won't have a job when your foot heals. We had a case like this where some kid broke his wrist on his first day on the job because he didn't know how to lift a pipe and was too afraid to ask for help or instructions... went on WCB, didn't get fired, came back and didn't last a week cause he got harassed by everyone else so badly.

    Oh, this wasn't mentioned but RECORD EVERYTHING. The WCB can be a bitch sometimes and if they decide that your playing it up or something you're SOL. Keep doctors notes/prescriptions and log what happens as well as the dates of each appointment, write down exactly what happened in the accident, and keep a log of what pain you experience everyday and what this pain keeps you from doing.     A little defensive?

    You know, there have been people who have worked construction all their lives without having to go on WCB. In fact, almost all the people I know haven't had to. From the way you worded it, it sounded like you just slid off the ladder. Did your foreman tell you to climb an unsecured ladder? How tall was this ladder? Did it have a 4:1 slope? I mean, let's put it this way... what would you think if you heard about someone going on WCB not even 1/6 through his first day on the job? I still say it sounds like the accident occured in part due to your inexperience.

    I've worked construction for a lot longer than your 1.5 hours, so don't bother with the Jerry Springer act. I'm not trying to start shit with you over the net, just trying to let know that you going on WCB will give a substantial rise to your company's premiums on what sounds like an accident caused by your inexperience, so keep that in mind when you're dealing with the situation... becuase that's probably why your boss sounded so pissed.
