So I bought a new house last year, and in our community you get a tree from the developer. I picked some red thing and had it planted a few months ago. Last week I put down the sod, and have been watering the shit out of it.

So I come home on Friday, and my tree has been replaced with a different tree, the border around the tree is totally not centered, and there's huge hills and pits in the lawn where the bobcat was.

No phone, no message, no reason - no permission.

So I'm really pissed. I've phoned the dev company to get info but I just get voice mail. I'm willing to press charges (vandalism? destruction of private property, theft? I dunno) if they don't completely fix the problem.

Has anyone heard of this before? The tree they took is the same size as the new one (a different type though). Mine wasn't dying or anything. Do I have a legal standing assuming they give me the run around?

No, it's like 10 feet from my front door. It is at least 18 feet on my property. There's a policy they can dig up to get at utilities but this is even beyond all the lines. (My neighbour watched them do it - it was soley for the tree replacement).

That's pretty bad. I'd call up the developer and rip them a new one. There's no way they should have fuct up your sod let alone replace a tree without telling you.

Where do you live? That sounds fairly high strung....even for the super controlled neighborhoods in Calgary i've never heard of anything like that..

Yea, and he could blame it on whoever ripped it out. "I duuno they ripped it out of your yard for no reason then planted it in mine"

Ha - I could see it except he already has the exact same tree.

The latest word, is they have no word. The only thing they can think of is that their crew hit the wrong house (in which case they will be re-leveling and resodding that whole section or I'll go nuts). Even if it's the wrong house, they need to find out why the crew would not question ripping out a perfectly healthy tree and replacing it with another similar one.

When I lived in Hidden Valley, they did this to one of my neighbors. The reason, aparantly, was the tree that was planted, didn't go along with the neighbourhood planning that was drawn up by the architect. Therefore, since it was within the one-year shingles-to-foundation warranty (kinda like bumper-to-bumper) they just came and replaced the tree with this scraggly little thing that ended up dying that winter. No notice, no word, and no repair of the lawn. He was super-pissed, but couldn't get the developer to do anything about it. I moved out before I know what finally happened, but just to let you know, you're not alone.

i say rip the tree out of the ground and go plant it on their buisness' front lawn, like all shitty, then poor gasoline all over their lawn, dont light it, just let it sit there so it kills all the grass and he will never be able to grow anything, try spelling out a word like COCK, or F U, or maybe FAGS, or TREE, or JEW. just whatever you want, make it big, you can also use any other solvent like old motor oil, or dog piss(has to be from a sick female)

and then when the crew comes back after they fix the lawn, come out and tell them to get on their knees and apologize, if they dont do it say you are gona report them, watch out tho, they probly have shovels so bring out a 9mm or just come outside naked.

Yeah, all new communities follow by an architectural theme. Like, the developer gets to approve of the color house you choose from a limited selection, what type of rocks/bricks can be used, and the style (country, victorian, arts crafts etc) that you pick. It's by code that houses must have a certain amount of tree/shrubature on it's property, and with the way the new communities work, everyone get's to pick a tree and put it in their front yard.

Technically, if you do anything out of the ordinary with your house (now this all comes down to how strict the developer is) with the architectural controls, you are in breach of contract. I remember when I bought my house last august, the contract that you sign with all the fine print had litterature regading architectural control, and that you must abide by them.
