So how does responsibility/party fault work in that situation?
I assume the dealership and their coverage will have to take the cost of the repairs? Or would the fool that was driving this be the one responsible under his insurance coverage?

If ever there was a poster for winter tires, this would be it. The rocks are there for more than looks, I am wondering what is just beyond the rocks? If he'd cleared a few feet right, no one needs to know anything about the close call.
I was in a simular situation in Michigan on all seasons, steered the big Pontiac (not my car) right between two big trees in a blinding snowstorm while rounding a corner. So tight the doors would only open a foot or so, we had to get out through the side windows. I always have winter tires, pity the fool.

That corner is about 600 meters north of Calgary Subaru, Meridian Road and 28 ST NE.
subaru's always seem to want to understeer :P
