IANAL, but, here's the thing, this seems to be a brand new offer, so whatever they discussed before has no legal weight on this offer. So this one could have all sorts of crazy conditions.

Notice how this latest offer came out after they released the text messages? I think he is realizing that he doesn’t want to put himself and some witnesses (his friends) through all this bullshit in the public eye and potentially get caught in a web of lies if they can’t get their stories straight. I mean, Elon Musk is a weirdo, an ego-maniac and probably a jerk. But so are most CEO's and billionaires. I don't use twitter, but that's because I hate the product, not anything to do with the executives themselves.
