    Hello Everyone,
    I need your advise on legal issue.

    I purchased a 98 explorer about 3 months ago at 110000km. I went to the dealership on friday only to find out that the vehicle was in there 2 years prior with 120000km.

    Here is the issue. The person I bought the truck from, bought the truck last year at 98000km (Poor bastard also got ripped), he has his bill of sale to prove it. He unsuspectingly sold the truck at 110000km to me.

    Can I go after the original owner of the truck directly myself or do I have to go after the person I bought it from.

    I say report it to the cops, tell them what you know and let them handle it...

    Cops are completely usless with issues such as yours, you can file a report and write a statement but nothing will happen most likely cuz there no proof of who did it. Take it into your own hands.

    maybe the simple answere is that the dealer messed up when recording the milage. another possibility

    Not likely, It's pretty hard to screw something like that up.

    It's possible. I had several SLK's with various odo readings, and all of them go to Lone Star for service. They recorded my SLK 230 reading onto my SLK 320 file once. Was a mess, but they fixed it eventually.

    its pretty easy to mixup odm readings at the dealer actaully...

    I once brought my Corolla into the dealership with 98 000 Kms on it. They told me my next oil change was due at 76 000 kms?

    The cops will definatly be intrested in this. People go to jail for rolling od's back. Also, AMVIC will also be intrested.

    I think you first need to find out what exactly has happened in the vehicles service records. You should be able to obtain a complete copy if you know where it was serviced...

    It might do some explaining as to what has happened. If the vehicle had an odo adjustment legitimately, it will show up somewhere in those service records.

    If you can truly determine when/where the odo rollback happened, you can probably get a lot closer to figuring out "who dunnit!" I would think you can't 'go after' anyone if you don't actually know (or can prove) who did this...

    The registry may be able to tell you all previous owners. Not sure if they will provide that information. But that'd be a thing to check on for sure...

    If you can prove that it was the original owner who rolled back the odometer, not the person you bought it from, you can't go after him. Only the person he fradulently took advantage of, could go after him in court.

    Please correct me if I am wrong, but I recieved this info from a lawyer friend.
