Default Pepper spray at NYLA Last nite

Sinse when do bouncers use pepper spray. Last nite at Nyla a fight broke out and The whole club was filled with pepper spray. Im not 100% sure if it was the bouncers but thats what i was told. Damn that stuff burns. I could feel it in the morning. My buddy got it pretty bad.

I doubt it was the bouncers. I've never been to NYLA, but I've never seen that anywhere else. (Bouncers using any types of weapons would lead to all kinds of assault charges), and who the hell wants to go to a club that fills up with pepper spray every time something goes wrong? (Pepper spray would be a very bad idea, seeing how it spreads everywhere… bring on the lost customers and lawsuits).

Bouncers cannot legally use pepper spray. It is a prohibited weapon under the Criminal Code, however there is a provision that allows peace officers to possess and use it. A person can possess bear spray as bear spray, but to use it against another person is illegal. Most likely somebody else set it off inside the bar - much as bouncers would probably like to have and use it, they aren't allowed to.

think about it, if a bouncer used pepper spray in the bar, the whole club would have to empty out, it would be unbearable. bouncers are however allowed to carry batons as long as they are visable on their belt or otherwise "not concealed". few clubs allow this tho, batons arent exactly welcoming.

What provisions give bouncers the right to carry baton's and normal citizens can't?

Most batons are not illegal per se for anyone to possess. They are illegal if they are concealed or have an assisted opening mechanism, such as a spring load. They become illegal if you use them in a manner 'dangerous to the public peace.' This can include displaying it in a threatening or perceived threating manner- which means that if you go walking around with one on your belt you may find that its more trouble than its worth.

using it on someone is an entirely different kettle of fish, of course.

So those ASP Collapsable Batons are illegal because they have an "assisted opening mechanism"?

However, if one were to carry say, a baton like you see police carry in the movies (1-2 feet long stick), as long as it's visable it's OK?

cops will find a way to make anything illegal if they want to, one time a friend of mine and his friends got pulled over for no reason, they found nothing illegal other than a baton which they charged my friend for "possesion of a banned weapon", this is weird because he bought it from Spy City.
