    Default Consequences of driving with a suspended license?

    Just wondering if you got your license suspended and were caught driving, what would the consequences be? Would you get thrown in jail or what? Or does that depend on how long your suspension is?

    J-hop would probably say, you need to be doing stupid shit to get pulled over. Now if you followed the traffic rules, chances are slim you would get pulled over. If a CPS was driving behind you, what are the chances of them just running your plate? Plate is registered to guy who has his license suspended therefore must pull him over.

    Also, the effect of this on your driving record? Insurance? Do you tell insurance or just let them find out on their own? haha

    My apprentice got caught with a 1 month suspension and after court fees and impounding was about 6 grand and they tacked on 2 years more.

    Did the "30 minutes or free" delivery policy net you a suspension Max? I'd point the blame at CN.

    Believe its a min fine of $2000 and an automatic 6 months extra suspension.

    Technically they can imprison for up to 6 months if they deem.

    Suspended licenses suck. Took me 5 years after my original suspension to be able to get insurance (no longer on my 5 year abstract). At the time I was 18 and so stupid that I drove to court... fully well knowing I probably wouldn't have a license coming out of court.

    Oh this doesn't apply to me. We were just talking amongst friends over beers and no one really knew so I said, let me ask Beyond haha

    Roughly three years ago, friend was serving a 3 month suspension (alcohol related). She was just under two weeks from receiving license back.

    Got caught driving 80 in a 60 on Macleod. Cop quickly realized that she had a suspended license. He said he was being nice about not arresting her. Car was towed/impounded, she was then given a court date in which judge gave her a fine (she didn't disclose amount) and threw down a full year suspension.

    I wonder if you can find out how many times.your plate has been run by CPS. I'd be willing to bet that in 6 years of driving mine has been hit 500+ times

    Definitive answer?:

    It depends on what the reason is for the suspension and the prior history.

    If it's a traffic suspension, or a license suspension due to not paying child maintenance, the charge is under S. 94(2) of the TSA:

    Prohibition re driving while unauthorized

    94(1) For the purposes of this section, a person is an unauthorized driver if

    (a) that person’s operator’s licence is suspended or cancelled under this Act,

    (b) that person is disqualified from driving a motor vehicle in Alberta,

    (c) that person’s licence or permit to operate a motor vehicle in a jurisdiction outside Alberta is suspended or cancelled, or

    (d) that person’s privilege to secure a licence or permit to operate a motor vehicle in a jurisdiction outside Alberta is suspended or cancelled.

    (2) A person shall not drive a motor vehicle on a highway at any time during which that person is an unauthorized driver.

    RSA 2000 cT‑6 s94;2003 c42 s15

    Punishment re driving while disqualified

    95(1) A person who is guilty of contravening section 94 is liable

    (a) for a first offence to a fine of not more than $2000 and in default of payment to a term of imprisonment of not less than 14 days nor more than 6 months, and

    (b) for each subsequent offence committed within one year after the commission of the offence referred to in clause (a), to imprisonment for a term of not less than 14 days nor more than 6 months.

    (2) Subject to section 98, a person who is guilty of contravening section 94 is disqualified from driving a motor vehicle in Alberta for a period of 6 months from the day of the finding of guilt.
    So, a fine of up to $2000 for a first offence (I think the average fine is about $500), plus a further 6 month suspension on a first offence. If you're caught a second time within a year, it's jail for 14 days, plus another 6 months suspension.

    If it's a driving prohibition from a conviction under the criminal code for impaired driving, dangerous driving, flight from police, etc. Then the consequences are more severe. There is a criminal charge for driving while disqualified (S.259(4)) and jail sentences are usually imposed on first time offenders. Probably something like 30 days for a first offence, but it would ramp up quickly from there.

    Don't mean to derail the thread but what about this:

    Getting caught riding an insured and registered motorcycle when you only have a class 5? Insurance issues related to this?

    I heard it's a fine of under $200 and if the cops a dick will impound your bike but may let you get away with having a licensed driver move it.
    We stopped checking for monsters under our beds when we realized they were inside us.

    ^ There is no law against insuring and registering a motorcycle if you only hold a class 5. You will have a few hoops to jump thru to get that done, but it can happen.

    The fine is improper use of a licence and if my memory serves me correctly its $172 and they can impound the bike. (I could be a little off on the amount though)

    I was young and dumb once. Drove my car insured under a friend. Suspension came up, so i drove myself to my meeting with the board of transportation. Didnt realize that they had the parking lot set up sneaky, and so that every spot is reserved except where you can park for the meeting, which they watch from the window in the board room.

    Went in, they played dumb, i played dumb. They let me know what they knew, and i looked like an idiot. Fortunately they tacked on 3 extra months, and let me get my friend to drive the car away, no siezure of the car.


    4 years later now, no tickets, clean and clear license.

    Holy shit serious business. The system kicks your ass!

    So best thing to do is drive a rental car and if you get pulled over, say you don't have your license and give the cop the name of your sibling?

    ^ I've actually seen that happen. Long story short, guy used his brothers name over and over with RCMP/CPS instead of his own, brother ended up pressing fraud charges against the delinquent brother and it got messy. The bad brother ended up serving jail time and had a criminal record by the time it was all said and done.
