    Default whos fault?

    ok I just want everyones opinion, I was driving down a main road here in lexington 2 nights ago. The road is a 5 lane road at the point where the wreck happened. there is 4 lanes and a turning lane. Well it was dark and I was in the far right lane. I was in a geo metro and was doing 5 below the speed limit. there was a station waggon on my left. Well out of no where I hit a tow truck. ok but here is where its confusing. The tow truck had been in the middle lane of traffic waiting to back into a repair shop to tow a car. He had been facing the opposite direction with no lights on and he just started to back up through the two lanes that were headed south bound. I was just wondering if everyone thinks its his fault too. I cought the back left corner and toatalled the geo. it was more on his left side then the back.

    it is a little confusing... I was headed south bound. the tow truck was stopped in the turning lane (headed north) on my right hand side was a auto shop. The tow truck was trying to back across the south bound lanes of traffic to back into this auto shop. he did not have his top lights on so I didnt see him until I hit him in the side of the flat bed.

    thats a tough call... your fault for not paying attention, but his fault for not having his lights on and making sure it was clear to do such a manuver.

    thats the thing I was paying attention but I couldnt see him for the station waggon that was just infront of me until the woman driving slammed on her brakes and by that time it was to late for me.

    #1 did you get station wagon owner as your witness?

    #2 Both of you have to slam on the brakes?

    #3 Did the cop charge tow truck with traffic violations?

    Yes to those 3, get a laywer.

    If the tow truck driver did what he did without any warning, he lacks common sense.

    was the station wagon already stopped and you passed it?? If so i could see them trying to pass on the blame to you saying you should have see the other car stopped and at least attempted to slow down to see what was going on...what if it had been a pedistrian that the other car had stopped for??

    Holy crap thats pretty crazy shit if the tow truck actually tried to back up into the body shop by taking up like couple lanes to do it without looking at traffic.... and plus how can you not see a big ass tow truck backing up or something blocking not only your lane but the lane next to you as well.... were you drinking???

    Why get a lawyer?

    This is for insurance companies to deal with.

    I assume you filed a police report? And I assume you reported to your insurance company?

    They take care of this, not some lawyer you'll have to pay.
