    Default Restrictive covenants - Land titles

    I’m trying to understand how to find out about restrictive covenants for properties. They should be listen on the title as I understand but I’m looking at a title for a family members house and it just lists “restrictive covenants” under “encumbrances, liens & interests” but not details about what the covenants are.

    Do I need to request more details from the land titles office to know what they are? It doesn’t look like the title is missing pages or anything like that.

    Let me know beyondlopedia.

    Maybe it has none? I have an encumbrance for a yearly fee that I have to pay, other than that there's nothing. Going to put up a giant PORKY'S sign next month.

    For an urban home its usually shown on the RPR. Not sure about rural.

    Look to the left of the restrictive covenant and you will see a registration number.

    Take that number and go to the SPIN2 website, click search
    Then click on Titles & Registered documents
    Then click on Registered documents
    Then click on Document registered number
    Then enter your number and hit search
    Costs $5 to $10 for the documents

    So if a restrictive covenant states you have to have the approval of the community to make changes, what does that even mean? Obviously people don’t follow them anymore they change their house color/fences etc all the time haha

    What sort of changes does it say? There are easy ways to get around it legally.

    I’m just trying to learn about this out of pure curiosity around chain link fences everywhere.. I don’t believe the approving corporate body exists anymore that they’re referring to as Douglasdale (Douglasdale estates inc). So what’s stopping anyone from slapping a big wooden fence in place of the chain link?

    legally it may need a judges order if the corporation doesn’t exist, for a fence don’t think anyone will care?

    I think NIMBY’s/Karens would raise a stink if one person swapped their back fence to lumber on a green space.. but I agree there has to be some backup to hold the restrictions. Just curious what it is haha..

    Dunno. My last place the community went to war against a developer from putting in some gaudy Aspen style front driveway.

    University Heights has a number of restrictive covenants. They have all been supported by the courts. Neighbors with enough money will take the violator to court and usually win.

    Best way to apply for the changes you want to make is during a holiday in the winter months, like Christmas. City will throw out a sign on your street with said changes, if nobody challenges those changes, the city will approve it. Most people are away during the holidays or shitty winter days so they usually go un noticed. With all this commotion going on with blanket rezoning I have a feeling the city will be jammed with complaints.

    I don't believe that's how restrictive covenants work. Its not like advertising a development permit.

    Do restrictive covenants ever expire? I thought they did X amount of years after a development is complete.

    Restrictive covenants is a pretty broad term, and in some cases they don't effectively expire until the residents of the community stop caring about enforcing them.

    no the Gov of Alberta website says unless specified no expiration..

    Front drives are tricky, normally you need at least 50% of the block already occupied by front drives.

    Not sure what is gaudy about a front drive, take that over an alley any day of the week.
