False. What needs to be investigated for the court to have any leg to stand on with this decision, is if covid vaccination in transplanted individuals reduces the mortality rate from covid infection in this group.

But to investigate properly, doctors would need to do a scientific study with a group of significant size of vaccinated and unvaccinated patients of each organ. But the organs themselves are so scarce that no-one will be seen as potentially wasting viable organs on people that may be at higher risk because of a flaw in their reasoning and judgement. You can draw parallels here with this group and unchanging alcoholics being refused liver transplants.

So instead they extrapolate from the massive, multi organizational study that found Covid increases risk of death by 25-30% in transplant patients, that caused a change in medical procedure. Organ transplantation requires heavy immuno suppressive drugs to prevent organ rejection.

Liver transplant (for example) is ~25% so goes from 1/4 to 1/2. I'm guessing that's bad odds for the viable organ with a waiting list of people with better odds.
