Pretty sure your brother got fleeced by his realtor being inadequate. The conditions of the contract are clear and if the buyer does not take possession of the property they forfeit their deposit as well as are liable for any expenses accrued (realtor fees). Tell them to pound sand and if they want to lose the deposit go ahead.

This is also why you ensure the buyers leave a reasonably large deposit as part of the offer too. Don't let them get away with 5k deposit, they should have a sizeable chunk of their downpayment ready to put as a deposit.

But realtors are useless.
