Based on Chicago convention of Civil Aviation, USA is within its right to shoot it down based on sovereignty of air space and CCP's balloon has more than 4kg of payload so it's doesn't qualify as weather balloon.

Yes, it could definitely have been space observing as well as weather. UV sensor might not be pointing to earth for example. I have zero doubt that it had earth facing standard cameras though.

It could and probably did have a Starlink satellite communication transmitter on it - just to see how strong the signal is at that altitude if not communicate directly. The antenna would literally cost a few hundred dollars, and add a couple pounds weight. It is what I would do.

If it was intially arctic, it probably had at least one sensor to monitor the ozone hole.

What the USA really needs to do is define "spy" from the 1940's definition. Technically all weather balloons "spy" on the atmosphere, including any aircraft that pass through it, they "spy" on the gases coming off of the earth, including factories in the middle of nowhere. You can't unsee a factory on the ground.

Weather observation is a thing, since the dawn of man - literally one of the most important things to observe. I can imagine a decade from now, they are going to find some frozen bodies on the top of Mount Washington because someone didn't bother the check the weather report before leaving.
