Default US citizen working in Canada, but serving only US customers

A friend is moving here from the US more or less permanently and his wife has an online business in the US that she wants to continue to do via zoom/remote. She will only have US based customers.

    - Does she need a visa to work/stay here?
    - Is her income in Canada taxable?

They would maintain residences in both the US and Canada, so technically her income would be completely domestic to the US.

I think if she does any work that will somehow includes Canada then she would have some responsibility to the government, but if she is strictly working online "while vacationing", and all sales/work is in USA only and all monies/goods stays in USA then she is probably fine, but if she is receiving anything into Canada work related of money deposits etc she could be on the hook somewhat.

    Does she need the income?

Draw no salary and keep the business 100% US domiciled?

It's not a taxation issue, it's a legal work issue. I'm not sure she would care too much about paying Canadian taxes, it's more about whether or not you have the "right" to work in Canada in this fashion.

Probably illegal. I base this solely on the fact that it shouldn't be.

My guess, she needs a visa if she's going to do this by the book.

I dont think this is the case, I think "working" in Canada, only counts if your work is *in* Canada.

You'd need someone smarter than me to confirm that. I didn't think location of your customers was much of a factor.

Full disclosure to customs would answer the question quickly

It absolutely makes a difference. Just reading more about this, it sounds like she would be considered a "digital nomad" which Canada is actually encouraging to come.

This. It’s where you are located when you perform the work. The location of your customers doesn’t matter. If she’s running her own business I personally would probably play in the grey, but if she is an employee or contracting for someone then she would be be considered as working in Canada. I can’t remember what you get as a grace period 30 or 90 days but you couldn’t do it permanently without a visa if you’re staying above board.

Edit: “digital nomad” wasn’t a thing when I was part of dealing with this for my team so maybe it’s a post covid thing.

canada taxes on residency. where's the primary residence but i've heard of tax rules for part-time residence too.
i imagine she'll need a PR eventually if she wants to stay in Canada permenantly?

I’m still just trying to figure out what would possess someone to move to Canada.

Unless they are coming from Gaza or something

Why not just stay in Gaza and Strip?

You’re only allowed 6 months as a digital nomad since you’re classified as a visitor and can only visit for 6 months. Nothing needed afaik as a digital nomad coming from US as she wouldn’t need a visa to visit. After which you need a work visa. I think the process is relatively easy going from visitor/digital nomad.

This is exactly the info. She will be doing the residency thing, but just wants to ensure she can manage everything with her remote business and do it all inland. Visitor running your business temporarily while getting all of the paperz in order seem to be the solution.
